Description

1. The subject-matter of the contract is the successive supply of acidified vegetables to military units and training centres in accordance with the assortment-quantitative list contained in Chapter IV – ‘Description of the lot’ of the FTZ and in the ‘Proposal form’ attached as Annex 1 to the FTZ. 2. In accordance with Art. 1 of the Public Procurement Act, the Contracting Authority provides for the possibility of exercising the ‘Option Rights’. The ‘option right’ will be exercised under the same conditions and time limits as the basic contract. If the Contractor does not exercise the ‘Option right’ as regards the scope of unrealised deliveries set out in the tables in Chapter IV of the FTZ, in the column entitled ‘Quantity in option’, he is not entitled to any claim against the Contracting Authority, including in particular a claim for payment of the expected benefits. ‘Option law’ means that the quantity of the subject-matter of the contract ultimately ordered will depend on the current demand of the Ordering Party. The Contracting Authority will inform the Contractor of its intention to exercise the ‘Option right’, together with the quantity of the subject-matter of the contract and the place of its delivery, within the time limit set out in the ‘Draft provisions of the contract’, which are attached as Annex 5 to the FTZ. 3. During the performance of the contract, the contracting authority does not allow the use of substitute packaging for the food products under investigation. 4. The Contractor is obliged to inform the Ordering Party in writing about any change in the presence of allergens in the delivered products. 5. The Contractor is responsible for ensuring the safety and proper hygiene of food products with particular regard to the applicable legal provisions. 6. The contracting authority described the subject-matter of the contract by reference to standards. The contracting authority therefore indicates that it allows solutions equivalent to the standards described.
