Description

In accordance with Article 79(1)(1) of the Public Procurement Act, the ‘Hristo Botev’ Primary School in Rakovski is conducting a negotiated procedure without prior publication with a view to designating a contractor for a public contract for: ‘Supply, installation, commissioning and warranty service of furniture for a training room, a discussion room, an amphitheatre and a storage facility for the construction of a STEM centre in the Hristo Botev Primary School in Rakovski, under the procedure of the Recovery and Resilience Facility BG-RRP-1.015 ‘STEM SCIENTIFIC ENVIRONMENT’ of the National Recovery and Resilience Plan of the Republic of Bulgaria’. The contracting authority shall award the contract in accordance with this procedure, having regard to the fact that it has conducted an open procedure for: ‘Supply, installation, commissioning and warranty services of furniture, computer equipment and accessories, by lot, for the construction of a STEM centre and a VOSS facility at Hristo Botev Primary School in Rakovski, following a procedure under Recovery and Resilience Facility BG-RRP-1.015 ‘STEM SCHOOL SERVICE’ under the National Recovery and Resilience Plan of the Republic of Bulgaria, opened by Decision under Article 22(1) of the ZOP with № F729929, published on 14 August 2025, respectively. Contract notice with № F729961, published on 14.08.2025 (number in ROP 03202-2025-0004) and pursuant to Decision № D49310033 of 17.10.2025 of the Contracting Authority, which entered into force, the procedure was terminated in the part of Lot № 1: ‘Furniture for a study room, a discussion room, an amphitheatre and a repository’, as a single tender was submitted and was defined as ‘inappropriate’ and not eligible for the participation of the Contracting Authority, respectively, at the time of the initial conduct of the procedure, it was found that all the tenders submitted under Lot № 1 were inadequate and the conditions initially announced for this contract were not substantially altered. In this regard, under these conditions, Article 79(1)(1) of the Public Procurement Act applies, according to which the contracting authority may conduct a negotiated procedure without prior publication where the procedure initially opened has been terminated due to inappropriate tenders and the terms of the contract initially announced have not been substantially altered.
