The contracting authority shall award the contract in accordance with this procedure, having regard to the fact that it has conducted an open procedure for: ‘Supply, installation, commissioning and warranty services of furniture, computer equipment and accessories, by lot, for the construction of a STEM centre and a VOSS facility at Hristo Botev Primary School in Rakovski, following a procedure under Recovery and Resilience Facility BG-RRP-1.015 ‘STEM SCHOOL SERVICE’ under the National Recovery and Resilience Plan of the Republic of Bulgaria, opened by Decision under Article 22(1) of the ZOP with № F729929, published on 14 August 2025, respectively. In this regard, under these conditions, Article 79(1)(1) of the Public Procurement Act applies, according to which the contracting authority may conduct a negotiated procedure without prior publication where the procedure initially opened has been terminated due to inappropriate tenders and the terms of the contract initially announced have not been substantially altered.
