Description

1. The subject-matter of the contract is the provision of leasing services for domestic WAN links, hereinafter referred to as ‘the service’. 2. A detailed description of the subject of the contract is provided in Annex 5 to the FTZ and Chapter XIX of the FTZ. 3. The contracting authority shall not request that the evidence in question be submitted together with the tender. 4. In accordance with Art. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. Journal of Laws Ooh, ooh, ooh. EU L 119, 04.05.2016, p. 1), hereinafter referred to as "GDPR", the Contracting Authority informs that: 1) the administrator of your personal data is the Chief of Police; 2) supervision over the correct processing of personal data is carried out by the personal data protection officer: Address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: iod@ksp.policja.gov.pl 3) Your personal data will be processed on the basis of art. 1 lit. c GDPR for the purpose of a public procurement procedure conducted in an open tender procedure for: Provision of rental services of domestic WAN lines, ref.: WZP-2262/25/157/Ł; 4) the recipients of your personal data will be persons or entities to whom the documentation of the proceedings will be made available pursuant to Article 18 and Article 74 sec. 1 of the Act; 5) Your personal data will be stored, in accordance with Article 78 of the Act, for a period of 4 years from the date of completion of the procurement procedure, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract; 6) the obligation for you to provide personal data directly concerning you is a statutory requirement specified in the provisions of the Act, related to participation in a public procurement procedure; the consequences of failure to provide certain data result from the Act; 7) in relation to your personal data, decisions will not be taken in an automated manner, application to Article 22 of the GDPR; 8) You have: a) on the basis of Article 15 of the GDPR, the right to access your personal data; b) on the basis of Article 16 of the GDPR, the right to rectify your personal data*; c) pursuant to Article 18 of the GDPR, the right to request the controller to restrict the processing of personal data subject to the cases referred to in Article 18 para. 2 GDPR**; d) the right to lodge a complaint with the President of the Office for Personal Data Protection if you consider that the processing of your personal data violates the provisions of the GDPR; 9) You are not entitled to: a) in connection with Art. 3 (b), (d) or (e) of the GDPR, the right to erasure of personal data; b) the right to transfer personal data referred to in Article 20 of the GDPR; c) on the basis of Art. 21 GDPR, the right to object to the processing of personal data, because the legal basis for the processing of your personal data is Art. 1 lit. b, c and f GDPR. *Explanation: exercising the right to rectification may not result in a change in the outcome of the public procurement procedure or a change in the provisions of the contract to the extent inconsistent with the Act and may not affect the integrity of the protocol and its annexes. **Explanation: the right to restriction of processing does not apply in relation to storage, to ensure the exercise of legal remedies or to protect the rights of another natural or legal person, or for important reasons of public interest of the European Union or of a Member State. 5. Article 257 provides for the annulment of the procedure if the public funds which it intended to use to finance all or part of the contract have not been awarded to it. 6. Requirements for employment on the basis of an employment relationship in the circumstances referred to in Article 95 of the Act: 1) The Ordering Party requires employment by the Contractor or Subcontractor on the basis of the employment relationship of persons performing the following activities in the scope of contract performance: supervising the proper functioning of links. 2) during the performance of the contract, the Ordering Party is entitled to perform control activities towards the Contractor regarding compliance by the Contractor or Subcontractor with the requirement of employment on the basis of the employment relationship of persons performing the activities indicated in point 1. In order to verify compliance with these requirements, the Ordering Party is entitled, in particular, to request: a) statements by the employee, b) statements by the contractor or subcontractor on the employment of an employee under an employment contract, c) certified true copy of the employee's employment contract, d) other documents - containing information, including personal data, necessary to verify employment under an employment contract, in particular the name of the employee, the date of conclusion of the employment contract, the type of employment contract and the scope of the employee's duties; 3) The Contractor shall submit to the Ordering Party, at each request of the Employer within the time limit specified in this request, the evidence indicated in point 2 in order to confirm the fulfilment of the employment requirement on the basis of the employment relationship by the Contractor or Subcontractor of persons performing the activities listed in point 1. Penalties for non-compliance with these requirements shall be specified by the Ordering Party in Chapter II. XIX SWZ. 4) in case of reasonable doubts as to compliance with labour law by the Contractor or Subcontractor, the Ordering Party may request an inspection by the National Labour Inspectorate. 7. The contracting authority, in accordance with Article 139 of the Act, provides for the reverse order of operations, i.e. it may first examine and evaluate the tenders and then make a qualitative selection of the Contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. 8. Period of performance of the contract: 24 months from the date of conclusion of the contract.
