Supply of drugs, infusion fluids, preparations for enteral and parenteral nutrition and contrasts
1. The subject of the order are successive deliveries on order of the Ordering Party of drugs, infusion fluids, preparations for enteral and parenteral nutrition and contrasts, divided into 50 parts of the order. 2. A detailed description of the subject-matter of the contract, including assortment, doses, forms and quantities, is set out in Annex 2 to the SWZ – Assortment and Price Form. 3. The assortment which is the subject of the contract must be authorised for marketing and use in the territory of the Republic of Poland in accordance with the Pharmaceutical Law Act of 6 September 2001 (consolidated text: Journal of Laws 2026, item 612). The Contractor is obliged to have all the documents required by law allowing the offered medicinal products to be marketed and to present them at the request of the Ordering Party (excluding medicinal products imported in the mode of final import). 4. The tenders submitted must indicate the commercial name of the preparation, the size of the package, the name of the manufacturer, the GTIN/EAN code, the authorisation number of the marketing authorisation and the details of the product. If the offered packaging of the drug contains a different number of units (e.g. tablets, ampoules), the Contractor is obliged to calculate the number of packages accordingly. Where an incomplete number of packages is obtained, the quantity shall be rounded up to the nearest package. The EAN code indicated in the Assortment and Price Form (GTIN) is for information purposes and serves to identify the offered product as at the date of submission of the offer. A change in the EAN (GTIN) during the term of the contract, resulting from a change in the packaging, distributor or commercial designation, while maintaining the same active substance, dose, pharmaceutical form and marketing authorisation number, does not constitute a change in the content of the offer or an amendment to the contract. 5. The ordering party allows the exchange of tablets for capsules (and vice versa), the exchange of ampoules for vials (and vice versa) provided that the same form of the drug is retained. However, it does not allow the replacement of drugs with prolonged action and modified release with a drug in the form of a classic tablet, dragees, capsules. 6. The contracting authority requires that, in order to maintain the safety of pharmacotherapy, different doses of the same medicinal product contained in one Task should come from one manufacturer - this applies to the same form of the drug.
