‘Reception and management of municipal waste from inhabited and non-inhabited real estate from the area of the Commune of Wiązownica in the period from 01.01.2026 to 31.12.2026’

4.1. The subject of the contract is the systematic collection and management of municipal waste from residential and non-residential properties located in the municipality of Wiązownica, in a way that ensures that the municipality achieves appropriate levels of recycling, preparation for re-use and recovery by other methods and reduces the weight of biodegradable municipal waste sent for storage and equipment of residential and non-resident properties in containers for the collection of mixed municipal waste. 4.2. The subject of the contract also includes carrying out at least once a year educational activities/actions in 8 primary schools in the municipality of Wiązownica: Cetula, Manasterz, Mołodycz, Piwoda, Ryszkowa Wola, Szówsko, Wiązownica, and Zapałów and kindergarten departments, in terms of proper management of municipal waste, in particular in terms of separate collection of waste. 4.3. Washing and disinfection of all mixed waste containers located in the municipality of Wiązownica during the term of the contract. 4.4. Washing and disinfection of waste containers may take place at the waste collection point provided that the Contractor uses specialist equipment, i.e. vehicles equipped with equipment for washing and disinfecting containers, ensuring the circulation of water from washing containers in a closed system. 4.5. The Contractor shall maintain in a proper sanitary and cleaning condition an area contaminated with waste and other contaminants discharged from containers, bags and vehicles during the performance of the service. 4.7. The following types of waste will be collected and managed: 1) municipal waste (mixed) and waste from separate collection, 2) waste collected separately: - paper and waste paper, packaging made of paper and cardboard, - glass, packaging made of glass, - plastics, - multi-material packaging, - metal, packaging made of metals, 3) bio-waste, 4) furniture and other bulky waste, 5) used tyres, 6) used electrical and electronic equipment, 7) hazardous waste, 8) used batteries and accumulators, 9) expired medicines and waste ineligible for medical waste, generated in households as a result of receiving medicinal products and injecting and monitoring the level of substances in the blood, in particular needles and syringes, 10) clothing, 11) textiles 4.8. Option law 1) The contracting authority provides for the possibility of exercising the option right by increasing the estimated weights of waste to be collected during the term of the contract. 2) The exercise of the right of the Option may not result in an increase in the total maximum remuneration of the Contractor referred to in § 5 of the contract by more than 15%. The value of the Option will be related each time to the value specified in § 5 of the Agreement as at the date of its conclusion, regardless of any changes and valorization of this value during the term of the Agreement. 3) The Ordering Party shall provide the Contractor with a written statement on the use of the option no later than within 10 days from the date of receipt of a correctly issued invoice from the Contractor for the month in which the waste collection was carried out, with a value representing 80% of the maximum remuneration specified in § 5 of the contract. 4) The Ordering Party may use the option once for the entire value of the option or in several parts. If the option is exercised in several parts, the Ordering Party shall submit further declarations to the Contractor no later than before 80% of the value of the option triggered resulting from the previously submitted declaration is exhausted. 5) The right to exercise the option does not constitute an obligation of the Ordering Party, nor does it constitute a basis for the Contractor to pursue claims for damages for failure to perform the contract covered by the option. 6) If the Ordering Party exercises the right of option, the Contractor shall be entitled to remuneration for the services actually provided on the basis of the option, constituting the product of the mass of waste collected and transferred for management and collected and managed and indicated unit prices. 4.9. Environmental aspect 1) The Contractor must ensure a minimum share of low- and zero-emission vehicles in the total number of vehicles covered by the contract: categories M1, M2 and N1 as referred to in Article 68a(2); 1 point 1) of the Act of 11 January 2018 on electromobility and alternative fuels. The share of electric or hydrogen-powered vehicles in the total number of vehicles of those categories in the performance of the contract shall be at least 22%, except that, until 31 December 2025, hybrid or natural gas-powered vehicles with a maximum real-driving emissions of 50 g CO2/kmi below 80% of the emission limit values shall be included in that share; category N2, N3 fuelled with alternative fuels referred to in Article 68a(b). 1 of the Act of 11 January 2018 on electromobility and alternative fuels. The share of alternatively fuelled vehicles of categories N2 and N3 in the total number of vehicles of those categories in the performance of the contract shall be a minimum of: 7% from 1.7.2024 to 31.12.2025 9% from 1.1.26 to 30.06.2027 4.10 The contracting authority does not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provision of Art. 1 of the law. 4.11. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 7 of the above-mentioned Act.
