Description

The municipality of The Hague has the statutory task (Article 5:8(3) of the Civil Code) to store and care for found animals in need (animals with a presumed owner) for at least two weeks. The Municipality of The Hague wishes to lay down the following specific tasks contractually: - The care of dogs and cats - Part of the task is the extra care and inoculation of young kittens. In addition to the statutory tasks, the municipality of The Hague has a number of non-statutory tasks. The municipality also wants to have these tasks carried out within the same contract: - Prevention task stray cats; In addition to the cats that are kept as pets, The Hague also has a large number of cats with a wandering existence. The number of stray cats can increase significantly if measures are not taken in time. Intended result - The contractor ensures that the municipality complies with its legal obligations for the reception and care of found dogs and cats and contributes to the prevention of stray animals. Description of task - Keeping and caring for dogs and cats found in the municipality of The Hague that presumably have an owner for two weeks; The reception of sick and injured dogs and cats is not part of this task. - Part of the task is the extra care and inoculation of young kittens. The Contract was put out to tender in accordance with the negotiated procedure without prior notice. The Contracting Authority has consulted the Candidate it has chosen through this procedure and has negotiated the terms and conditions of the Assignment. The Candidate concerns Stichting Haags Dierencentrum in The Hague (HDC). Following a market consultation carried out by the Contracting Authority and a European procedure without valid Tenders, HDC was selected to participate in the negotiated procedure. The contracting authority relies on the exception provided for in Article 2.32(1)(b) of the 2012 Procurement Act: the absence of competition for technical reasons. The Contracting Authority publishes a Notice of Voluntary Transparency in advance in accordance with Article 4.16 of the Aw2012. Within a period of twenty (20) calendar days, Entrepreneurs may notify themselves who object to the intention of the Contracting Party to award the Assignment as a result of the Tender Procedure that has been completed. This period of 20 calendar days suspends the final award of the Assignment. If an Entrepreneur reports within twenty (20) calendar days with a (grounded) objection to the award of the Assignment, the Contracting Party is entitled (and possibly obliged) to suspend or terminate the Procurement Procedure. If an interlocutory injunction has not been filed in advance within twenty (20) calendar days of the dispatch of the Notice of Voluntary Transparency, the Entrepreneurs who have passed may no longer raise objections to the decision and have processed their rights in this regard. In that case, the contracting authority is therefore free to comply with the award decision. Other Entrepreneurs have in that case also processed their rights to bring a claim for compensation in substantive proceedings. If an application for interim measures has been lodged, the award will not be made unless this is urgently required. Text automatically translated in your browsing language Automatically translated
