Description

1. The subject of the contract is a service consisting in servicing medical equipment at Copernicus PL Sp. z o. o. in Gdańsk. The subject of the contract has been divided into 10 lots. 2. A detailed list of equipment for the service is described in the Price Form (Annex 1 to the SWZ) and in the Schedule of inspections (Annex 2 to the contract). The subject-matter of the contract must be performed in accordance with the provisions of the draft contract. 5 to the SWZ - and in accordance with the schedule, which constitutes Annex No. 2 to the contract. 3. Persons assigned to perform the contract must have qualifications specified by the manufacturer of medical devices. 4. As part of the service provided, the Contractor is obliged to apply and comply with the law applicable to the subject of the contract, have appropriate rights and bear full responsibility in the event of their violation. 5. Pursuant to Article 95 para. 1 of the Public Procurement Act, the Employer requires employment by the Contractor or a subcontractor on the basis of an employment contract within the meaning of the Labour Code of 26 June 1974 (Journal of Laws No. Journal of Laws 2019, item 1040, 1043 and 1495) continuously throughout the duration of the Agreement, persons/persons performing activities related to the implementation of the subject of the contract. 6. At the latest on the date of commencement of the service, the Contractor shall provide the Contracting Authority with a statement on the fulfilment of the requirement referred to in para. 6, i.e. that the person(s) performing activities related to the performance of the subject of the contract will be employed under an employment contract within the meaning of the Labour Code Act of 26 June 1974. 7. At each stage of contract implementation, the Contracting Authority has the right to verify the declaration of the contractor/subcontractor (concerning the form of employment of the persons referred to in sec. 6). To that end, it shall be entitled, in particular, to ask the competent labour inspectorate to carry out an inspection. 8. The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act.
