1 The subject of the contract is the supply of stocking material of pike in the form of autumn fry. 2 The contracting authority shall allow partial tenders to be submitted. The contract consists of the following parts: 1) Part 1: Delivery of 57 kg of pike in the form of autumn fry along with delivery to the fishing circuit of Lake Samińskie on the Samionka watercourse in the Brynica river catchment; 2) Part 2: Delivery of 1 391 kg of pike in the form of autumn fry with delivery to the fishing circuit of Lake Płaszczyckie on a watercourse without a name in the catchment area of the Brda river, the fishing circuit of Lake Szczytno on the Brda river No 3, the fishing circuit of Lake Wyrówno on a watercourse without a name in the catchment area of the Wda river, the fishing circuit of Lake Słone on a watercourse without a name in the catchment area of the Wda river; 3) Part 3: Delivery of 237 kg of pike in the form of autumn fry along with delivery to the fishing circuit of Lake Krąg on the unnamed watercourse in the Wierzyca river catchment and the fishing circuit of Lake Damascus on the unnamed watercourse in the Motława river catchment (Szpęgawa); 4) Part 4: Delivery of 85 kg of pike in the form of autumn fry along with delivery to the fishing circuit of Lake Wielkie on the Łeba River No. 1 and the fishing circuit of Lake Otalżyno on the Gościcina River. The detailed scope of the subject of the contract, the conditions for its implementation and the obligations of the Contractor for a given part of the contract include: - Description of the subject-matter of the contract - Annex 1 to the FTZ, - Draft provisions of the contract - Annex 6 to the FTZ. 3 The contracting authority does not allow the division of the contract into individual lots. The contracting authority awards the supply contract in lots and this contract is one of those lots. 4 The Contractor may submit an offer for one or more lots. 5 The description of the subject-matter of the contract shall specify the quality requirements relating to at least the main elements making up the subject-matter of the contract, which fulfils the conditions of Art. 2 of the PPL Act. 6 The contracting authority does not allow variants to be submitted. 7 The Contracting Authority does not provide for the possibility of awarding the contracts referred to in Art. 1 point 8 of the PPL Act. 8 The Ordering Party does not reserve the obligation for the Contractor to personally perform the key parts of the contract. 9 The Employer does not provide for the possibility of exercising the right of option referred to in Article 441 of the PPL 10. The Employer does not specify the activities related to the performance of the contract, which are subject to the requirements of employment by the Contractor or subcontractor of persons performing activities during the performance of the contract on the basis of an employment relationship. 11 The Contracting Authority does not require the Contractor to employ the persons referred to in Article 96(2)(2) of the Public Procurement Act. 12 All costs related to participation in the procedure, in particular the preparation and submission of a tender, shall be borne by the Contractor submitting the tender. The contracting authority does not provide for reimbursement of the costs of participation in the procedure. 13 The Ordering Party reserves the right to cancel the present proceedings on the basis of Article 257 of the Public Procurement Act if the funds which it intended to allocate to the performance of the contract are not granted to it in whole or in part. The contracting authority is entitled to cancel the procedure for the above-mentioned condition at any stage of the procedure and in respect of selected parts of the contract. The contracting authority retains the right to cancel the procedure on the above-mentioned condition both when it receives unequivocal information about not granting it funds for the performance of the contract, and in the event of delay in obtaining them in relation to the assumed date of performance of the task, if the lack of funds in time prevents the performance of the contract. The Contractor does not have the right to request the Contracting Authority to take action to obtain funds for the performance of the contract, if these will not be granted to him from the assumed source. In the event of annulment of the procedure pursuant to Article 257 of the Public Procurement Act, the Contractors shall not be entitled to reimbursement of any costs of participation in the procedure, including, in particular, reimbursement of the costs of calculation and preparation of the tender and, by participating in the procedure on the terms set out in these documents, the Contractors shall accept without reservation. 14 Procedure plan no. in BZP: 2025/BZP 00112251/13/P; Item of the plan: 2.2.181
