1. The subject of the contract is the provision of comprehensive services in the field of, among others, planning, buying airtime and advertising space in the media (TV, press, radio), outdoor advertising, the Internet (including, among others, social media, podcasts, vod, streaming services, paid advertising in search engines), cinema and non-standard activities (e.g. cooperation with influencers, ambient marketing, event marketing, printing materials, realization of broadcast materials, special projects of Publishers, etc.). The Employer will conduct advertising campaigns: social, informational, educational and promotional activities aimed at informing specific groups of recipients about ongoing projects in the field of, among others, cybersecurity, disinformation, science and research, .pl domain, digital education, new technologies and other related to the activities of the Ordering Party; As part of the comprehensive service provided, the Contractor will be obliged to perform services (tasks) adapted to the activities and campaigns currently carried out by the Contracting Authority; Materials necessary for the issue or publication of advertising activities will be transferred by the Ordering Party or the entity indicated by the Ordering Party; 1) The Ordering Party assumes the performance of the subject of the contract in the maximum amount of PLN 30 000 000.00 net during the period of performance of the Contract. 2) The Employer allocates the following net amounts for the purchase of utilities (together with the remuneration of the Contractor - media house): a) TV – PLN 12 000 000 +/- 30% b) Radio – PLN 3 000 000 +/- 30% c) Press – PLN 1 500 000 +/- 30% d) OOH/DOOH – PLN 2 250 000 +/- 30% e) Internet – PLN 7 500 000 +/- 30% f) Non-standard activities – PLN 3 750 000 +/- 30% 3) The minimum which the Contracting Authority plans to allocate to the performance of the contract is PLN 8 000 000.00 net. 4) With regard to the option right, the Ordering Party provides for the allocation of PLN 5 000 000.00 net for the purchase of utilities (including the remuneration of the Contractor – media house), divided in proportion to the above-mentioned point 2) and specified in detail in Chapter V of the SOPZ. 2. A detailed description of the subject of the Order is included in Appendix No. 1 to the FTZ. 3. Deadline for the execution of the contract: The subject of the contract will be implemented in the basic scope successively for 30 months counted from the date of conclusion of the Agreement or from the date of conclusion of the Agreement until the advertising budget is exhausted, i.e. the amount indicated in § 9 sec. 2 Contracts, or after exercising the right of option § 9 sec. 3 Contracts, whichever occurs first. 4. In cases where the detailed description of the subject-matter of the contract indicates trademarks, patents, origin, source or a specific process that characterizes the products or services provided by a specific Contractor, which would lead to the preference or elimination of certain contractors or products, this means that the Contracting Authority cannot describe the subject-matter of the contract with sufficiently precise terms and this is justified by the specific nature of the subject-matter of the contract. In such situations, any indication of trade marks, patents, origin, source or particular process shall be read with the words ‘or equivalent’. 5. Where reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and reference systems referred to in Article 101(1)(b) and (c) and (c) of Regulation (EC) No 207/2009, reference shall be made to those standards, technical assessments, technical specifications and reference systems. 1 point 2 and paragraph. 3 of the Public Procurement Act, the contracting authority pursuant to Art. 4 of the PPL Act allows for the use of equivalent solutions. Whenever a standard, technical assessment, technical specification or technical reference system is indicated in this FTZ, it shall be presumed that ‘or equivalent’ is used for it. 6. Under the concept of equivalent solutions, the Employer understands such a solution that satisfies the conditions set out in the SOPZ to an equivalent extent. 7. The Contractor who invokes the equivalent solutions described by the Contracting Authority is obliged to prove in the tender, in particular by the means of evidence referred to in Articles 104-107 of the Public Procurement Act, that the solutions proposed by him meet the requirements specified in the description of the subject of the contract to an equivalent degree. Evidence, in particular the means of proof referred to in Articles 104-107 of the Public Procurement Act, confirming that the solutions proposed by the Contractor meet the requirements specified in the description of the subject of the contract to an equivalent degree shall not be supplemented. 8. The contracting authority does not allow negotiations to be conducted in order to improve the content of tenders submitted in response to the contract notice. 9. Method of evaluation of tenders: When selecting the most advantageous tender from among the non-rejectionable tenders submitted in response to the contract notice, the contracting authority will be guided by the criteria and their meaning and will evaluate the tenders within the tender evaluation criteria. The Ordering Party shall award the contract to the Contractor whose Offer will obtain the highest number of points.
