Description
1. The subject-matter of the contract is the supply of articles whose summary and indicative requirements are set out in the ‘Price Forms’ annexed to the specifications.
2. The contract is divided into 9 lots.

4. The contracting authority shall allow the submission of partial tenders. The contractor may submit a tender covering all or one or more lots. However, in order to be valid, the tender must cover all the items listed in the price form for the lot selected.
5. The items offered must be as described in the ‘Price Forms’. If the tender contains articles which do not meet the requirements set out in the ‘Price Forms’, the tender for the whole lot will be rejected because its content would be contrary to the terms of the tender specifications.
6. The transport of medicinal products must comply with the conditions set out in the Regulation of the Minister for Health of 26.7.2002 on procedures for good distribution practice (Journal of Laws No 144, item 1216):
A. § 6. 1. The loading and transport of medicinal products shall be carried out in such a way as to guarantee:
(1) identification of the medicinal product,
(2) identification of the sender and recipient of the medicinal product,
(3) protection against cross-contamination of medicinal products,
4) protection against contamination, mechanical damage or theft,
Protection against harmful effects of high and low temperature, light and humidity and other adverse factors,
(6) a temperature specified by the responsible operator or in the relevant pharmacopoeia, in the case of medicinal products requiring such conditions;
B. The contracting authority shall provide for the possibility of carrying out random checks on transport conditions (e.g. the presence of facilities to ensure adequate transport temperatures). Any failure to fulfil obligations will result in failure to accept the goods with annotation of the cause and full consequences for the Contractor (see draft contract § 5(2), § 6(1), § 7, point 3).
7. The quantities of items ordered in the price forms are estimated. During the performance of the contract, the number of items to be procured will depend solely on the actual needs of the Contracting Authority.
8. However, in cases where trademarks, patents or origin have been used to define the contract, it is always permissible to submit equivalent tenders, i.e. for articles of no lesser value than those of the articles in question, it being understood that equivalent medicines must contain the same active substance and have the same form and scope of action. A contractor relying on solutions equivalent to that described must demonstrate that the supplies it offers meet certain requirements.
9. As a result of this procedure, each Contracting Authority will conclude separate contracts with the Contractors and the Contracting Authorities will not be jointly and severally liable for the obligations they have entered into. Sub-contracts and supplies will be carried out independently from each other to the Contracting Authorities’ Hospital Units within the time limits set out in Table 1.
10. Annex 5 to these Specifications for Relevant Conditions contains a summary of medicines indicating the estimated quantities of individual preparations by place of delivery.
