The contractor is obliged to carefully check the description of the subject of the contract due to the fact that the supply contract is a flat-rate contract. 2.3. In the case of an indication in the description of the subject-matter of the contract, in an annex to the tender, in the design of the trade mark, patent or origin, the source or a specific process that characterizes the products or services, this serves only identification purposes. Names are only a precise description of the class and technical parameters of products required by the Ordering Party and are only exemplary. Pursuant to Article 99 of the Public Procurement Law, the Contracting Authority allows for the possibility of submitting in this respect tenders that are qualitatively equivalent and meet the equivalent parameters specified in the description. By equivalent product, the Ordering Party understands the product, with the same or better parameters than the proposed product or device and consistent with the documentation describing the subject of the contract and the product, corresponding to the technical and logical solutions used - Offered devices and equivalent materials, must have appropriate certificates required by law or admission to trade, so that the Ordering Party can check whether they meet the requirements set out in the Order Terms and Conditions. In such a situation, the Employer requires proof of this fact by the Contractor, and in particular the submission of relevant documents confirming that these materials or devices are equivalent2.4.
