The subject matter of this contract includes the supply, installation, commissioning and warranty service of a factory-new automatic immunoassayer for the needs of the University Hospital "St. George" EAD, detailed in the Technical Specification – Annex 2 of the tender documentation. The contract is concluded conditionally within the meaning of Article 114 of the Public Procurement Act and its implementation starts after sending an assignment letter (confirmation of secured funding), which can be sent within 12 months of the conclusion of the contract. The contracting authority shall not suffer any negative consequences in the event of failure to provide financing and failure to send a letter of assignment within the time limit, such as penalties, indemnities or the like. In the event of failure to provide financing within 10 months of the conclusion of the contract, the contract shall be terminated, this fact being certified and becoming undisputed between the parties in one of the following ways: By written notification from the CONTRACTING AUTHORITY to the CONTRACTOR for failure to provide financing; With the CONTRACTING AUTHORITY's confirmation of a written request of the CONTRACTOR sent after the expiry of the 10-month period; In the absence of correspondence from the parties, with the fact of the expiry of the period provided for in the contract for sending an assignment letter and the absence of such sent.
