Description

1. The subject of the contract is the successive supply of light heating oil for heating purposes to military units and institutions that are on demand of the 12th Military Economic Branch. 2. The contract is not divided into lots due to the uniform nature of the contract and delivery costs. The estimated base order is 618 437 litres of fuel oil. The Contracting Authority shall guarantee to the Contractor the performance of the contract value of a minimum of 25% of the basic contract. 3. The contracting authority provides for the right of option (optional contract) referred to in Art. 1 of the Public Procurement Act in this case. The exercise of the option right will consist in increasing the amount of heating oil under the concluded contract, up to a maximum of 50% of the basic order, i.e. up to 309 218 liters, by submitting a unilateral statement by the Ordering Party - an order in writing. If, during the performance of the contract, it turns out that the Ordering Party has the financial means and the need to order more heating oil in relation to the amount envisaged in the unconditional scope of the contract, the Ordering Party reserves the right to exercise the ‘option right’ and to order additional heating oil under the concluded contract, for which the Contractor will be entitled to separate remuneration. In the case of exercising the option, the settlement will be based on the unit price of heating oil that is in force on the day of delivery on the website https://a.orlen.pl/PL/DlaBiznesu/HurtowePenyPaliw/Party/ minus the amount of the discount, which is fixed during the term of the contract. The Ordering Party reserves that the part of the order referred to as the right of option is a right and not an obligation of the Ordering Party. The exercise of the right of option may or may not take place, depending on the Customer's needs and as a result of his disposition in this respect. Failure to perform the order in this respect will not give rise to any claims on the part of the Contractor against the Ordering Party. The Contracting Authority shall provide the Contractor with information on the exercise of the option right in writing by 30 June 2026. 4. The contracting authority requires the submission of personal evidence in the procedure in question (requirements are included in Chapter X of the SWZ) 5. In accordance with Article 139 para. 1 of the Public Procurement Act, the Contracting Authority informs that, in the first place, it will examine and evaluate the tenders, and then it will perform the subjective eligibility of the Contractor whose tender has been awarded the highest score, as regards the lack of grounds for exclusion and fulfilment of the conditions for participation in the procedure. 6. In accordance with Chapter XIV of the SWZ-, the Contractor is required to lodge, before the closing date for the submission of tenders, a security in the amount of: PLN 71 980.00. 7. In accordance with Chapter XXI of the SWZ-, the successful tenderer is required, before signing the contract, to lodge a performance bond equal to 3 % of the total price quoted in the tender. 8. The Contractor shall be obliged to complete the subject-matter of the contract within the following time-limits: in the basic scope and the right of option from the date of signing the contract until 31.07.2026 9. Pursuant to Article 57 of the Public Procurement Act, Contractors may apply for the award of a contract if they: - shall not be excluded; - meet the conditions for participation in the procedure concerning: 9.1. ability to trade in the economy; The contracting authority does not specify requirements in this respect. 9.2. the right to conduct a specific business or professional activity, if it results from separate provisions: The Contractor will meet the condition if it proves that it has a current license to conduct business in the field of trade in liquid fuels granted on the basis of the Act of 10.04.1997.
