Description

Due to unforeseen circumstances which FMI could not have foreseen at the time of the call for tenders, FMI needs to activate the possibility of ordering spare parts and optional deliveries before the formal entry into force of the sustainment contract, to increase the maximum purchase of optional deliveries and to add two additional optional deliveries to FMI’s contract with Rohde & Schwarz GmbH & Co KG for BRASS EO. It is FMI’s view that these acquisitions do not constitute an amendment to a fundamental element of the contract, including as the acquisitions are covered by Section 183 of the Public Procurement Act, and that the acquisitions can therefore be made within the procurement process held and the procurement law framework for changes to contracts. Amend as follows: Expansion of the number of optional supplies to be purchased in accordance with the Agreement (Maintenance Contract). Replacement of spare parts and a product subject to an optional delivery as well as addition of products as new optional deliveries. Modification of the terms of the agreement so that spare parts and optional deliveries can be purchased before the entry into force of the agreement. Modification of the relevant index for the price adjustment of spare parts and other items and for Services. Implementation of price regulation of spare parts and other items at a time other than as provided in the Agreement.
