Description

1. Name of the contract: Banking services for the budget of the City of Krakow and granting overdrafts in 2026-2031. 2. The subject of the contract is to provide banking services to the Municipality of Kraków, i.e. 163 entities with independent financial and accounting services [including, among others, the Polish Financial Supervision Authority, the Polish Financial Supervision Authority, the Polish Financial Supervision Authority, the Polish Financial Supervision Authority, the Polish Financial Supervision Authority, the Polish Financial Supervision Authority, the Polish Financial The City of Krakow Office and the Municipal Education Service Centre (MCOO)] and 209 budget units providing financial and accounting services to MCOO, i.e. a total of 372 units and granting overdrafts in 2026-2031. 3. The detailed description of the subject of the contract includes the draft provisions of the contract (including Annexes 1-5) constituting Annex 10 to the FTZ, hereinafter referred to as PPU. 4. The information section for Contractors as at 31 December 2023 and 30 September 2024 is attached as Annex 11 to the FTZ. For more information, see point 3.5. SWZ. 5. The Employer informs that in the Public Information Bulletin of the Employer on the website: https://www.bip.krakow.pl/?bip_id=1&mmi=5 the documents referred to in point 3.6 are available. SWZ. 6. The Contracting Authority shall make available to the Contractors the documentation in Annex No 12 to the FTZ referred to in point 3.7. SWZ. 7. The contracting authority does not allow the submission of partial tenders. Justification for not dividing the contract into lots: In the present proceedings, there are circumstances justifying the abandonment of the division of the contract into lots due to the possibility of excessive technical difficulties and costs of contract performance (e.g. different IT systems in banks and integration of the contracting authority’s systems with different banking systems). In addition, the Contracting Authority points out that the need to coordinate the actions of the various contractors (banks) implementing the different parts of the contract for the banking service of the budget of the City of Krakow could seriously jeopardise the proper performance of the contract. 8. The contracting authority does not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provision of Art. 1 of the Public Procurement Law Act (hereinafter referred to as the "Act"). 9. The contracting authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 7 of the Act. 10. The contracting authority in these proceedings does not require the Contractors to submit the evidence in question. 11. The Ordering Party does not envisage conducting an electronic auction. 12. Prior to the opening of the procedure, the contracting authority did not conduct a preliminary market consultation. 13. The Contracting Authority, within the limits set out in Article 462 et seq. of the Act, allows the Contractor to perform the subject of the contract using subcontractors to the extent specified in point 3.15 of the FTZ. 14. Watch out! Correct description of the heading "electronic catalogue" in point 5.1.12. of the notice is - the Ordering Party in this order does not require the submission of an electronic catalogue, within the meaning of Article 93 of the Act. 15. The Ordering Party requires the employment by the Contractor (or subcontractor) of all persons responsible for handling the subject of the contract, on the basis of the employment relationship, under the conditions described in the draft provisions of the contract, in accordance with point 3.17 of the FTZ. 16. Justification of the criterion price above 60%: Pursuant to Article 242 of the Act, the price is one of the criteria for the evaluation of tenders. The contracting authority specified in the draft provisions of the contract quality requirements relating to at least the main elements making up the subject-matter of the contract, in accordance with Article 246(2) of the above-mentioned Act. It is therefore permissible to use the price as a criterion for the evaluation of tenders weighing more than 60%. In addition, the subject of the contract is widely available and has established quality standards. In the case of contracts for financial services, such as banking services or the granting of credit, price plays a key role because: - directly affects the amount of costs incurred by the Local Government Unit (hereinafter JST), - these services are standardized and widely available, which minimizes the risk of significant quality differences between the offers of different contractors, - in addition, criteria such as the quality of services are often of limited importance, because banks provide services under uniform legal regulations and financial supervision. Under the Public Finance Act, local government units are obliged to spend funds in a targeted and cost-effective manner. In the case of bank loans or bank service fees, the main goal of JST is to minimize the costs of debt service and bank transactions, which directly affects the condition of the budget. In the case of banking services, the key factor of competitiveness is therefore the price - that is, the amount of interest, commissions and fees for maintaining accounts as part of the so-called annual service fee. In summary, the application of the price criterion with a weight above 60%, which consists of two elements, i.e. the annual fee for bank servicing and the interest rate on the overdraft facility, is fully justified in proceedings concerning bank servicing and credit for local government units. 17. In point 5.1.12. of the notice, the contracting authority indicated the correct deadline for submitting tenders and opening tenders, without the "+02:00" clause imposed by the system. 18. The contract was included in the 2025 procurement plan. Text automatically translated in your browsing language Automatically translated
