The subject of the contract are: Successive deliveries of milk and dairy products in 2026 – together with unloading in the warehouses of the 32nd Military Economic Branch located in military complexes located in the area of operation of the 32nd Military Economic Branch in Zamość: Zamość, Lublin, Chełm, Hrubieszów in the scope of 4 (four) parts. Case No: ZP/PN/52/2025 PART I: milk and dairy products,ul. Polish Army 2F, 22-400 Zamość PART II: milk and dairy products, ul. Zbigniew Herbert 49, 20-468 Lublin PART III: milk and dairy products, ul. Lubelska 139, 22-100 Single-serve chelm, extra butter, single-serve coffee cream. PART IV: milk and dairy products, ul. Dwernickiego 4, 22-500 Hrubieszów DETAILED DESCRIPTION OF THE SUBJECT OF THE ORDER Detailed description of the subject of the contract in the scope of PART I, PART II, PART III, PART IV specifies: 1) A detailed description of the subject-matter of the contract in respect of Lot No I – constituting Annex No 1a to the FTZ; 2) A detailed description of the subject-matter of the contract in respect of Lot No II – constituting Annex No 1b to the FTZ; 3) A detailed description of the subject-matter of the contract in respect of Lot No III – constituting Annex No 1c to the FTZ; 4) A detailed description of the subject-matter of the contract in respect of Lot No IV – constituting Annex No 1d to the FTZ; ATTENTION! The Contracting Authority shall provide as annexes a detailed description of the subject-matter of the contract for Lots Nos I, II, III and IV respectively, packed in a single file in ZIP format; this file in ZIP format will be placed on the purchasing platform under the tab ‘Attachments to the procedure’ as Annex 1 to the FTZ. The assortment and quantity list for individual delivery points within the scope of PART I, PART II, PART III, PART IV shall specify: 1) Assortment-quantitative list in the scope of Part I – constituting Annex 2a to the FTZ; 2) Assortment-quantitative list in the scope of Part II – constituting Annex 2b to the FTZ; 3) Assortment-quantitative list in the scope of Part III – constituting Annex 2c to the FTZ; 4) Assortment-quantitative list in the scope of Part IV – constituting Annex 2d to the FTZ; ATTENTION! The Ordering Party shall present as annexes the assortment and quantity lists for parts Nos I, II, III, IV packed in a single file in ZIP format; this file in ZIP format will be placed on the purchasing platform under the tab ‘Attachments to the procedure’ as Annex 2 to the FTZ. DETAILED REQUIREMENTS OF THE CONTRACTOR IN RESPECT OF THE DELIVERY 1. The Ordering Party reserves the right to exercise the option right under the Agreement (option right - 100% of the basic order) to the extent not exceeding the range and quantities included in the column "OPTION RIGHTS" in the Annex to the Agreement. 2. The final amount of food options purchased under the law will depend on the Ordering Party's current needs and financial resources. 3. Food purchased under the option right must meet all the requirements as for a guaranteed order. 4. The Ordering Party reserves the right to make quantitative transfers between individual assortment items being the subject of the contract under the following conditions: the transfers result from the needs of the recipients which could not have been foreseen at the time of conclusion of the contract; b) transfers may not exceed 40% of the quantity of a given assortment item and will be made on the basis of unit prices included in the Price Form for the offer; the transfers do not cause the maximum value of the contract to be exceeded. 5. The contracting authority reserves that the part of the contract defined as the ‘right of option’ is an entitlement and not an obligation of the contracting authority. The Ordering Party may not exercise the right of option, in particular in the event of failure to obtain funds for this purpose, and the Contractor shall not be entitled to any claims in this respect, which the Contractor hereby accepts by signing this contract. 6. The assortment-quantitative list for individual warehouses of the 32nd Military Economic Branch located in military complexes located in the area of operation of the 32nd Military Economic Branch in Zamość – delivery places is presented in Annex 2 - according to the part concerned. 7. If the Ordering Party exercises the right of option, the Contractor shall be entitled to remuneration at unit prices as for a guaranteed order. 8. The Ordering Party may exercise the right of option several times, until the maximum value specified in § 4 sec. 3 Agreements throughout the term of this Agreement. The Employer may exercise the right of option until 31 December 2026. 9. The Ordering Party shall notify the Contractor by telephone of its intention to exercise the option right, its scope, places and dates of delivery of optional deliveries. The exercise of the right of option does not require the annexation of this Agreement. 10. The further scope of the option right is described in the model contract annexed to the FTZ, as appropriate to the part in question. The other provisions concerning the Ordering Party’s requirements for delivery were included in the model contract constituting Annex 3 to the FTZ, as appropriate to the part in question.
