Description

The Bundeskunsthalle had procured licenses for itself from Microsoft through a corresponding trading partner. The Bundeskunsthalle (BKH) is entitled according to the current valid BMI opening clause of the BMI framework contract, because the Bundeskunsthalle is an affiliated company according to point c) "Other corporation, institution under public law" (tenant: bundeskunsthallede.onmicrosoft.com). Now the Bundeskunsthalle wants with effect from now on a Microsoft 365 E5 // CSP - contract // License Agreement with a selected trading partner: Charity / Nonprofit Staff Pricing - Complete teams included that meet Microsoft's compliance requirements to obtain licenses for the upcoming migration of email inboxes to M365/Outlook. Thereafter, the BKH • requires at least 120 licenses with an annual term - possibly more - flexibility is required • for the migration 185 E5 licenses with a monthly term (here it is to be ensured that the price is fixed for 6 months) The licenses should be ordered in the subscription model (either with a monthly or annual term), which would be available both through Microsoft and through resellers. The appropriate licenses for the BKH (License Agreement: Charity / Nonprofit Staff Pricing) are offered through resellers within a CSP contract. A different contractual model is out of the question for BKH. The BKH had procured an E5 license in 2023, so that it is eligible for the E5 license including teams, because since October 2023 teams have been removed from the E5 license package and must be procured for later recipients with a separate license. In summary: The BKH needs two positions: • for the migration 185 E5 licenses with a monthly term (make sure that the price is fixed for 6 months) - costs in EUR / month • after that the BKH needs at least 120 licenses with an annual term - if necessary more - flexibility is required Microsoft 365 E5 // CSP Agreement // License Agreement: Charity / Nonprofit Staff Pricing - Teams included Important: BKH does not accept a procedure that does not comply with Microsoft's compliance requirements (e.g. retrospective upgrade of an F3 license to an E5 license) because the reseller does not have a contractual basis for the team inclusion.
