The subject of this public contract (“public contract” or “concession”) is the supplier’s commitment to comprehensively provide the organisational, HW and SW equipment necessary for the provision of the client part of the European Digital Identity Wallet (“EUDIW”) within the meaning of Article 5a(2) of the eIDAS Regulation in the Czech Republic and to provide it on its own account and under its responsibility as a service to Czech citizens and residents. The contracting authority assumes that, for the purpose of fulfilling the subject of the concession, it will ensure that qualified certificates for electronic signatures are issued by the State Administration of Trust Services, s. p. o. (‘SSSVD’) to EUDIW holders with personal identification data (‘PID’) issued by the Czech Republic. These users will be allowed to use the electronic signature for non-professional purposes free of charge. The contracting authority reserves the right to discuss this precondition in a competitive dialogue with suppliers. The subject-matter of the contract will be further detailed in the contractual terms and conditions (hereinafter referred to as the ‘Terms and Conditions’, the ‘Draft Contract’ or the ‘Contract’, as the context requires), which the Contracting Authority will provide to the participants in the procurement procedure together with the invitation to participate in the competitive dialogue. The draft Contract and the definition of the subject matter, scope and method of provision of services will be the subject of negotiations in the competitive dialogue between the Contracting Authority and suppliers (i.e. the draft contract provided in the framework of the Call for Participation in the competitive dialogue means the basis for negotiations in the framework of the competitive dialogue). The contracting authority shall further specify the requirements for the subject-matter of the public contract or specify the subject-matter of the competitive dialogue in the invitation to participate in the competitive dialogue. Following the invitation to participate in the competitive dialogue, the Contracting Authority may provide additional supporting documents to qualified participants upon submission of a non-disclosure declaration (for details, see Article 4.3 of the Tender Documents). The aim of the competitive dialogue is to set the contractual and technical conditions of performance of the public contract appropriately to meet the needs of the Contracting Authority and the relevant current legislation for the entire duration of the Contract.
