1.The subject-matter of the contract is ‘Maintenance of section DW 971 with a total length of 20,033 km (section No 015 km 5+056 – section No 060 km 2+866)’, hereinafter referred to as ‘the subject-matter of the contract’. 2. The contract covers the provision of services in the field of winter and summer maintenance of sections of provincial road No. 971 indicated in paragraph. 1, in the field of paving, mowing grass, tree care, cutting branches and boughs for two seasons of LUD (2025/2026, 2026/2027) and in the field of winter maintenance of the road and the part of the road intended for pedestrian traffic (hereinafter referred to as pavements) for three seasons of ZUD (2025/2026, 2026/2027, 2027/2028). 3. Winter maintenance of roads and the part of the road intended for pedestrian traffic (hereinafter referred to as ‘walks’) under ZUD 2025/2026, 2026/2027, 2027/2028 includes: 1) snow removal of the roadway along the entire width, in accordance with the standards of winter road maintenance, which constitute Annex No. 1 to the contract, 2) combating winter slipperyness according to the existing needs resulting from weather conditions by using chemical agents or non-chemical scrubbing materials. 3) export of accumulated snow and ice from the roadsides, sidewalks to the place indicated by the Ordering Party within 3 working days from the moment of notification by the Ordering Party, 4) post-winter cleaning of the road and municipal sidewalks, and in particular collecting accumulated impurities including used materials during the ZUD campaign, 4. Summer Maintenance (LUD) 2025/2026, 2026/2027, includes: 1) bilateral mechanical sweeping of streets and pavements with a sidewalk sweeper, 2) mechanical mowing of the roadside, including manual mowing around posts, barriers, signs, 3) cutting branches, boughs and removing samosieów, 4) ordering and disposal of organic waste resulting from the work. 5. The Contractor undertakes to carry out the work in accordance with the terms and conditions set out in this invitation and the annexes forming an integral part thereof, and in particular to: 1) compliance with health and safety regulations and fire safety regulations, 2) ensuring ongoing telephone communication, 3) cooperation with the Contracting Authority's services, 4) agreeing on the scope of services, 5) diligence in the performance of the contract, understood as the diligence of a professional in the activities covered by the contract, 6) maintaining roads in a state free of communication obstacles, 7) securing, marking vehicles and equipment throughout the duration of the task and ensuring proper technical condition. 6. The Contractor declares that the works related to the maintenance of section DW 971 with a total length of 20,033 km (section No 015 km 5+056 – section No 060 km 2+866)" will be carried out in accordance with the requirements set out in the applicable regulations, in particular: - The Contractor undertakes to ensure safety conditions and to mark motor vehicles in accordance with the provisions of the Road Traffic Act of 20 June 1997. - The person providing the service is obliged to have the qualifications required by law to drive vehicles, as well as to insure against civil liability. - The Contractor undertakes to prevent, mitigate and eliminate winter slipperiness with materials in accordance with the Regulation of the Minister for the Environment of 27 October 2005 on the types and conditions of application of measures that may be used on public roads and streets and squares. - The Contractor shall be obliged to know and apply all environmental protection provisions at the time of performance of the subject-matter of the contract. 7. With regard to the ZUD, the Contractor declares that the required works will be carried out in accordance with the standard of winter road maintenance according to Annex 1 to the contract and undertakes to appoint and maintain on-call duty from the moment of the first occurrence of adverse weather conditions until their spring resignation. 8. The Contractor undertakes to set up his own on-call services. 9. The Contractor undertakes to complete all works related to the horizontal cleaning of the road and pavements by 30.04.2028. 10. At each stage of the Contractor's performance of tasks in the field of summer maintenance and winter maintenance and road protection, the Ordering Party reserves the right to full control of documentation and equipment and storage facilities for materials and raw materials, as well as the methods and correctness of work. 11. The contractor is responsible for the waste generated in the course of its own work and the proper way of handling it, in accordance with the provisions of the Waste Act and the Act on maintaining cleanliness and order in municipalities. 12. The export and disposal of organic waste shall be at the Contractor's expense.
