Description

The subject of the contract is the provision of the service of collection and management of municipal waste from residential and uninhabited real estate located in the Municipality of Wierzbica. 2. The scope of the contract covers the collection, transport and management (in accordance with the waste hierarchy) of municipal waste in such a way as to ensure the achievement of appropriate levels of preparation for re-use and recycling, the level of landfilling of municipal waste and waste resulting from the treatment of municipal waste and the level of reduction in the weight of biodegradable municipal waste sent to landfill, in accordance with the provisions of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws No. Journal of Laws 2024, item 399, as amended) and the currently applicable implementing acts to the above Act, the provisions of the Provincial Waste Management Plan for the Lubelskie Province and the provisions of the Regulations for maintaining cleanliness and order in the Wierzbica Commune in force during the term of the contract, in particular: 1) collection, transport and management of municipal waste, regardless of the weather conditions, from any place from residential and uninhabited properties located in the municipality of Wierzbica, including supplying the property with bags for the collection of municipal waste and replacing bags on stands at stops and parking lots; 2) collection, transport and management of waste indicated by the Ordering Party delivered by residents of the Wierzbica commune to the Stationary Point of Selective Municipal Waste Collection (hereinafter referred to as PSZOK) on the day of its opening; 3) conducting an educational campaign in 2 educational institutions in the municipality of Wierzbica. Dates of meetings and facilities will be determined by the Ordering Party in consultation with the Contractor. 3. Quality requirements relating to the subject-matter of the contract: - the Act of 13 September 1996 on maintaining cleanliness and order in communes (Journal of Laws No. Journal of Laws 2024, item 399, as amended), - the Waste Act of 14 December 2012 (Journal of Laws 2023, item 1587, as amended), - the Environmental Protection Law Act of 27 April 2001 (Journal of Laws 2024, item 54, as amended), - the Act of 11 September 2015 on waste electrical and electronic equipment (Journal of Laws No. Journal of Laws 2024, item 573), - the Act of 24 April 2009 on batteries and accumulators (Journal of Laws of 2024, item 1004, as amended), - the provisions of the Provincial Waste Management Plan for the Lubelskie Province, - the Regulation of the Minister for the Environment of 10 November 2015 on the list of types of waste that natural persons or organisational units that are not entrepreneurs may recover for their own needs and acceptable methods of their recovery (Journal of Laws of 2016, item 93), - the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws of 2013, item 122), - the Act of 23 April 1964 - the Civil Code (Journal of Laws of 2013, item Journal of Laws 2024, item 1061, as amended), - the Public Procurement Law Act of 11 September 2019 (Journal of Laws 2019, item Journal of Laws 2024, item 1320), - acts of local law, issued on the basis of the statutory delegation contained in the above-cited acts. 4. The expected amount of waste collected and managed, i.e. the amount of Mg of waste that the Contractor is obliged to collect during the contract implementation period, will be approx. 750 Mg in the basic range. 5. According to Art. 433 para. 4 of the Public Procurement Act, the Contracting Authority informs that the minimum value of the service for the basic scope is 50% of the gross contractual remuneration indicated in § 9 sec. 1 draft agreement. 6.
