1. The subject of the contract is: 1) delivery of 4 brand new MIDI class, zero-emission, low-entry, low-floor electric city buses; 2) recharging infrastructure – including 1 mobile charger – 2 X 60 kW = 120 kW. 2. A detailed description of the subject-matter of the contract and the technical specifications are contained in Annex 1 to the FTZ. 4. The Contracting Authority does not provide for the award of additional contracts referred to in Article 388(2)(b) of the Public Procurement Act. 5. The contracting authority took due care to eliminate any proper names from the procurement documents. However, if the procurement documents contain an indication of trademarks, patents or origin, source or specific process that characterizes the products or services provided by a specific Contractor (own names) and the Contracting Authority has not specified the equivalence criteria referred to in Art. 6 of the PZP Act, it should be treated as non-existent. Therefore, the Ordering Party does not require that the subject of the contract be carried out using the materials and products indicated by the name. Thus, the Contractor who offers to perform the contract using other materials and products is not obliged to submit a description of equivalent materials and products. 6. Where reference is made in the procedural documentation to standards, technical assessments, technical specifications and technical refund systems referred to in Article 101(1)(b) and (c) of Regulation (EC) No 207/2009, the Commission shall inform the Commission thereof. 1 point 2 and paragraph. 3 of the PZP Act, equivalent solutions are allowed. If equivalent solutions are offered, the Contractor is obliged to submit with the tender a description of equivalent solutions and demonstrate that they meet the requirements specified by the Contracting Authority. Whenever reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems, the words ‘or equivalent’ shall be added after their wording. 7. In accordance with Art. 1 point 4 of the Public Procurement Act, the Contracting Authority will reject an offer whose share of products originating in the Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014//25/EU apply by virtue of a Council decision, does not exceed 50% of the total value of the products covered by the offer. 8. The contracting authority will reject a tender in which the proportion of products (parts and components) in each of the buses supplied originating in countries which are parties to the GPA of the World Trade Organisation (WTO) on government procurement and which have concluded free trade agreements with the European Union covering public procurement rules does not exceed 50%. 9. Project co-financed under the European Funds for Western Pomerania 2021-2027 programme, Priority 3 European Funds for Mobile Western Pomerania Measure 3.1 Clean urban transport (ZIT). 10. In line with the rules governing the spending of funds, EU funds aim, inter alia, to implement the strategy for smart, sustainable and inclusive growth. These objectives are achieved by spending funds in a way that ensures, among others, the creation of high-quality jobs or the protection of the environment. 11. Contracts shall be awarded in such a way as to achieve the best possible outcome, including social, environmental or economic effects, in so far as any of those effects is achievable in the contract in question, in relation to the expenditure incurred, in accordance with horizontal principles. 12. The main goal of the project is to provide a good transport offer, guaranteeing safety and comfort of travel while reducing the negative impact of transport on the environment by increasing the use of modern low-emission urban transport. 13. Specific objectives of the project: 1) successive implementation of sustainable transport solutions in the functional area of the city; 2) reducing the emission of pollutenes into the atmosphere; 3) improving the accessibility of rolling stock for persons with disabilities; 4) improvement of air quality in the area of impact of the project; 5) reducing the risk of behavior for climate-dependent diseases. 14.In accordance with Articles 256 and 257 of the Public Procurement Act, the Contracting Authority provides for the possibility of cancelling the procurement procedure: 1) before the deadline for submission of tenders, if there are circumstances causing the continuation of the procedure to be unjustified, 2) if the public funds that the Contracting Authority intends to allocate to finance all or part of the contract have not been awarded to it. 15.Reasons for not dividing the contract into lots: In accordance with Article 362(1) of the Public Procurement Act, Article 91(1) of the Public Procurement Act does not apply to the award of sectoral contracts. 2 of the Public Procurement Act, however, the Contracting Authority informs that it did not divide the contract due to the fact that the subject of the contract includes the supply of 4 brand new MIDI class urban buses, zero-emission, low-entry, low-floor electric buses and 1 mobile charger – 60 kW. The subject of the contract forms one technologically related system, the functioning of which requires full compatibility. The division of the contract into lots could lead to technical incompatibilities. Failure to perform the contract comprehensively could jeopardise its proper performance. In addition, the Contracting Authority would have difficulties in enforcing its rights under the warranty/guarantee – for defects due, inter alia, to the possibility of declaring different warranty/guarantee periods and the possibility of transferring liability to another Contractor. Failure to divide the contract into lots does not restrict competition and ensures equal access for small and medium-sized enterprises. 16. In order to properly prepare the offer and estimate the costs of the service, the Ordering Party, due to the specificity of the subject of the contract, recommends making a local vision.
