Description

Subject of the concession: At the end of the present proceedings, the City of Ath (the contracting authority) will entrust the provision and management of the services to a concessionaire in return for the right to operate the services which are the subject of the contract. The award of this concession implies the transfer to the concessionaire of an operating risk linked to the operation of these services. The clauses of these specifications imply that the operator bears the risks of the contract (the risks of supply and/or demand) and therefore runs the risk of not recovering the investments and costs it incurs in the performance of the contract. This is reflected in the fact that no remuneration is to be paid to the concessionaire and that the concessionaire will have to pay a fee. A new architectural project was designed by a project author. It meets current standards of attractiveness, safety, functionality, durability and flexibility of uses. The reconstruction of the marina will start in 2025 and will be completed within 150 working days. An opening is envisaged in July 2025. The reconfiguration of the site will take place in several phases, the provisional schedule of which is as follows: - 07/2025 : Finalisation of the marina - 12/2027: Finalisation of the recreational area - 12/2028: Finalisation of silo car park - 12/2029: Finalisation of the landscaped area The offer for the management of the marina will have to deal with a period of work during which the suspension of fixed rents is possible. By publishing the contract for the operation of the marina during the permitted phase, the City of Ath thus wishes to allow the concessionaire to possibly interact with the project author team during the works phase in order to possibly refine certain functional and/or aesthetic details as far as possible. Similarly, the aim is to enable the concessionaire to prepare as soon as possible for the launch phase (marketing, marketing, equipment, etc.) for commissioning as soon as the site reopens. The site is free of any concession and contract. There are no staff to take over. The task includes all the tasks necessary for the efficient management of such a site, in particular: The operation of the multipurpose area (Horeca potential) The management, maintenance and cleaning of the technical premises of the marina (WC, showers, laundry room) The operation of the terrace and the surroundings within the limits of the perimeter granted The operation of the multipurpose area and the recreational area The management of all the services necessary for the proper functioning of the site The maintenance and maintenance of the site (building, terrace and approaches), in accordance with generally recognised principles in this area. The management of the captaincy, including the water station, a dedicated office/meeting room in the building The reception of boaters The possible rental of bicycles The establishment of a place to relay tourist information promoted by the Ath Tourist Office and the Picardy Wallonia Tourist Office (brochures, map point nodes, etc.) Fees: Fixed part: The fixed part of the fee is the annual payment of a fixed amount by the concessionaire. The fixed part may be different from year to year. The contracting authority imposes a fixed annual fee of at least €12.000.00 excl. VAT The tender for the management of the marina will have to deal with a period of work during which the suspension of fixed rents is possible (from 2025 to 2029). Variable part: The variable part of the fee consists in the payment of an amount calculated on the basis of a percentage of the annual turnover achieved by the concessionaire. The percentage may differ from year to year. The contracting authority imposes a minimum annual percentage of 2.5% of a minimum annual turnover of EUR 12 190.08 excl. VAT in 2025 EUR 305 929.75 excl. VAT from 2026 to 2029 EUR 611 859.50 excl. VAT (from 2030 to 2039) EUR 305 929.75 excl. VAT in 2040 Duration of the concession: The duration of the concession is foreseen for a period of 15 years from the conclusion of the concession contract.
