Description

Duration of the contract: 6 years.
The delegatee’s mission will be to:
— ensure the operation of the equipment by guaranteeing the quality and continuity of the public service to users,
— implement the most suitable study and marketing techniques for the commercial promotion of the equipment in accordance with management principles, maintain the attractiveness of the congress palace,
— carry out, in the course of performance of the contract, maintenance and major repairs and the renewal of operating equipment in accordance with a minimum programme defined over the duration of the contract,
— comply with existing regulations throughout the duration of the contract and any necessary upgrades to standards,
— ensure its monitoring and cleanliness.
The delegatee is responsible for managing the public service at his own risk. It will use its own departments and resources to carry out the delegated activity. It must be remunerated directly by the collection of revenue from users, on the basis of the rates determined in accordance with the arrangements laid down in the agreement. In return for the use of the assets made available by the delegating authority, the delegatee will pay it an annual fee.
As permitted by Article L.2224-2 1 of the CGCT, public service constraints will be imposed on the delegatee by the authority, such as the fact that the delegatee takes account of events traditionally organised at the congress palace, the provision of rooms to political parties during the official campaign of local elections, and an interesting position in terms of rental rates. In addition, investment expenditure may be proposed by the applicant in accordance with a multiannual programme. This expenditure may be partly taken into account by the local authority if it is necessary for the operation of the public service.
