1. Description of the subject of the contract: The subject of the contract is the collection from the premises of Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. in Tarnów of waste with code 19 12 12 arising as a result of the manual dismantling of bulky waste (hereinafter referred to as waste) together with the management of this waste. 1.1. The minimum guaranteed amount of waste (minimum guaranteed scope of the contract), i.e. the amount of waste that the Contractor is obliged to collect from the Ordering Party as part of the performance of the contract, is 500 (Mg). 1.2. The maximum amount of waste (the maximum possible scope of the contract), i.e. the amount of waste that the Contractor is obliged to collect from the Ordering Party as part of the performance of the contract in the event that the Ordering Party exercises the right of option, in the situation described in point 1.3, is up to 1300 (Mg). 1.3. If, during the contract performance period, the Contracting Authority's actual demand for waste collection turns out to be greater than the planned minimum scope of the contract under point 1.1, the Contracting Authority, in accordance with Article 441 of the Public Procurement Law, provides for the possibility of exercising the option right consisting in increasing the minimum scope of the contract to the maximum quantity indicated in point 1.2 (Maximum possible scope of the contract), as the largest possible scope of the contract, taking into account the right of option. Execution of the scope of the contract covered by the right of option (Maximum scope of the contract) is a right of the Ordering Party, which it may or may not use. Failure by the Ordering Party to perform the order, taking into account the right of option, cannot be the basis for the Contractor's financial claims against the Ordering Party. The implementation of the additional scope of the contract under the option right in point 1.2 (Maximum possible scope of the contract) will take place on the same terms as the implementation of the basic contract in point 1.1 (Minimum scope of the contract).
