Description

The subject matter of the contract is the supply of office furniture, hereinafter referred to as ‘furniture furniture’. The furniture offered must be new and unused, come from current production (year of production – 2015/2016), have the relevant certificates, attestations and reports authorising the furniture to be sold and used in Poland. The Contractor must provide a free warranty service for furniture.
The scope of the contract shall include: purchase of furniture with delivery to the Contracting Authority, unloading, lodging at the place indicated by the Contracting Authority, and assembly. “Assembly” means the installation of complete and ready-to-use furniture, taking into account its adaptation to the premises in which it will be used and to the elements present in those rooms (the assembly will consist, in particular, of setting or hanging, the levelling of the individual items of equipment subject to the contract).
3. The time limit for the guarantee. Minimum guarantee period required for furniture offered – not less than 24 months.
The guarantee period shall begin to run from the date of signature of the Receipt Protocol.
4. A detailed description of the subject matter of the contract is set out in Annex 2 to the ToR.
5. The time limit for performance of the contract. Required time limit for performance of the contract: 30 days after the date of conclusion of the contract.
6. The contracting authority shall allow equivalent tenders to be submitted in cases where the Contracting Authority indicates trademarks, patents or origin of the subject-matter of the contract, in accordance with the principles and requirements described in the ToR. The inclusion of trade marks is justified by the specific characteristics of the subject-matter of the contract and the Contracting Authority cannot describe the subject-matter of the contract by other sufficiently precise terms. The terms used in the specifications, referring to trade marks, patents or origin of the subject-matter of the contract must be read with the words ‘or equivalent’.
When offering an object equivalent to that described in the specifications, the contractor must maintain equivalence in terms of performance, functional and quality parameters, which must not be lower than those indicated by the Contracting Authority.
Economic operators may propose equivalent solutions with the same parameters or above, but they are required to prove equivalence. In the absence of documents proving equivalence, the Contracting Authority will assume that the tender does not meet the requirements of the ToR and will be rejected. Where the Contracting Authority indicates in the technical description the permissible tolerances or the range of technical parameters required, the parameters of the furniture offered must be within the ranges indicated by the Contracting Authority.
In the event of doubts as to equivalence, the Contracting Authority will be able to ask the Contractor and/or independent testing facilities capable of confirming compliance with the requirements for further clarification. During the implementation phase, it should be possible to verify the furniture delivered and, in the event of non-conformity, it is possible to withhold the entire supply together with an order for immediate replacement at the Contractor’s expense and responsibility. The product names, if any, and the producers thereof, are intended only to clarify requirements which could not be described by sufficiently precise and comprehensible terms.
In accordance with Article 30. 4 of the PPL, in the cases referred to in the Specifications, the standards, approvals, technical specifications and reference systems referred to in Article 30(1). 1-3 of the above Act, the Contracting Authority allows solutions equivalent to those described.
In Annex 2 to the ToR, the contracting authority allowed a dimensional tolerance.
