Description

1. The subject of the contract is the supply of a set of tools and power tools for the execution of electrical installations. 2. The subject of the contract was divided into two lots: Part 1 - supply of a set of power tools A detailed description of the subject-matter of the contract is contained in Annex 6a to the SWZ – which is also a description of the equipment offered. Part 2 - delivery of a set of tools for electrical works A detailed description of the subject of the contract is included in Annex 6b to the SWZ – which is also a description of the equipment offered. The contracting authority accepts the submission of partial tenders and informs that one contractor may submit tenders for all parts, i.e. two. Additional information: Description of the Offered Equipment should be submitted at the tender, in accordance with the model, which is Annex No. 6a and/or 6b to the SWZ (i.e. on the date of submission of tenders), because the specification of the service that will be provided if the tender is selected as the most advantageous one constitutes the content of the tender. At the same time, the content of the tender consists only of those items in the ‘Description of the Equipment Offered’ in which the Contractors must not only confirm the compliance of the parameters of the equipment offered with the minimum requirements of the Ordering Party – on the basis of the ‘meets/does not meet’ principle, but provide the full name of the manufacturer, the type and model of the equipment offered in order to unambiguously identify it and/or to specify the size of the technical parameters or characteristics of the equipment offered. Clarification of this information is necessary for the Contracting Authority to carry out the procedure and forms part of the content of the tender. Therefore, possible failure to submit the Offered Equipment Description on the date of submission of tenders, or failure to fill in, or incorrect filling in, the Offered Equipment Description, preventing the Ordering Party from identifying the offered equipment, or the inability to determine: whether the offered equipment meets the minimum technical requirements referred to in the model constituting Annex 6a and/or 6b to the FTZ will result in the absolute rejection of the offer, on the basis of the provisions of Article 226 sec. 1(2)(c) and/or Art. 1 point 5 of the PPL Act. However, those items in the Description of the Offered Equipment in which the Contractors should confirm only the compliance of the parameters of the offered device with the minimum requirements of the Ordering Party on the basis of: ‘meets/does not meet’ (without the need to specify the information), do not have the character of the content of the offer, but constitute a material means of proof that the offered supplies meet the requirements, characteristics or criteria specified by the Ordering Party, as referred to in Article 106 sec. 1 of the PPL Act. Therefore, if the original description of the offered equipment in the items: ‘meets/does not meet’ will be incomplete or inaccurate, the Contracting Authority will request the Contractor to submit or complete the Description of the Equipment offered, but in the part covering only these items: ‘compliant/non-compliant’ which, on the date on which the tenders were submitted, were filled in incorrectly or were not filled in at all by the Contractor. However, it is unacceptable to submit or supplement after the deadline for submitting tenders, the Description of the Offered Equipment in the part constituting the content of the offer, if it would serve to supplement the information initially not provided, or to change the originally specified size of technical parameters or features of the offered equipment. 3. The contracting authority shall allow partial tenders to be submitted. The Contractor may submit a tender for any number of parts of the procedure. 4. The contracting authority does not allow the possibility of submitting a variant offer.
