Description

1. The subject of the contract is the collection and transport of municipal waste from owners of real estate residing in the city and municipality of Nowa Sarzyna in the period from 1 January 2025 to 31 December 2025. The subject-matter of the contract shall include: 1) collecting municipal waste from owners of real estate inhabited from the area of the city and the municipality of Nowa Sarzyna; 2) transport of waste referred to in point 1 to the mixed waste sorting plant and separate collection, composting plant in Sigiełki, 37-418 Krzeszów; 3) establishment and operation of the Municipal Waste Selective Collection Point. 3. The Contractor is obliged to comply with the legal provisions in force during the term of the contract, in particular: 1) the Act of 14 December 2012 on waste (Journal of Laws No. Journal of Laws 2023, item 1587 as amended), 2) the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal of Laws No. Journal of Laws 2024, item 399), 3) the Act of 11 January 2018 on electromobility and alternative fuels (Dz. Journal of Laws 2024, item 1289), 4) of the Regulation of the Minister of the Environment of 11 January 2013 on detailed requirements for the collection of municipal waste from property owners (Journal of Laws No. Journal of Laws 2013, item 122), 5) of the Regulation of the Minister of Climate and Environment of 3 August 2021 on the method of calculating the levels of preparation for re-use and recycling of municipal waste (Journal of Laws No. Journal of Laws 2021, item 1530), 6) of the Regulation of the Minister of the Environment of 15 December 2017 on the levels of reduction of landfilling of biodegradable municipal waste (Journal of Laws No. Journal of Laws 2017, item 2412), 7) of the Regulation of the Minister of Climate and Environment of 10 May 2021 on the method of selective collection of selected waste fractions (Journal of Laws No. Journal of Laws 2021, item 906). 4. Due to the limited number of characters that can be entered into the content of the notice, a detailed description of the subject of the contract is provided in Chapter 4 of the CVT available on the website: https://ezamowienia.gov.pl/mp-client/search/list/ocds-148610-5ca7fc67-9303-4c30-9fad-94bf9910e1f9 5. Reasons for not dividing the contract into lots: The contracting authority does not provide for the contract to be divided into lots, since the subject-matter of the contract – the collection and transport of municipal waste – is homogeneous and covers the provision of services of the same type. Dividing the contract into lots, in the case of homogeneous services, would lead to an increase in the cost of providing the service and make it more difficult to coordinate it. Execution of the contract by one Contractor ensures better efficiency in the management of the service and supervision over its implementation, especially in the context of environmental law provisions that regulate waste management. Moreover, dividing the contract into lots would entail the risk of differences in prices for the provision of services in individual lots, which could lead to unjustified social protests related to the level of rates for municipal waste management. In addition, these differences could also concern the quality of the services provided, as Contractors performing the service in different parts could offer different types of containers or bags, as well as different standards of service to residents, which could affect the unequal quality of the services provided. All these factors confirm that the service of collection and transport of municipal waste is homogeneous, and therefore dividing the contract into lots would be unjustified both from an economic and an organisational point of view.
