1. The subject of the contract is summer and winter maintenance of cleanliness and maintenance of greenery in communal areas outside the road lane and in residential greenery areas for a period of 12 months from the date of conclusion of the contract divided into parts with the possibility of using the option. 2. The subject of the contract is divided into lots: Part 1: District 1 or Center, Downtown North, Downtown West Part 2: Zone 2 or Łagiewniki, Rozbark Part 3: Division 3 or Szombierki, Bobrek Part 4: Division 4 or Miechowice, Karb Part 5: District 5 is Stroszek, Sucha Góra, Stolarzowice, Górniki 3. The complex of parts covered by the contract in each part for the basic scope and the optional scope is the fulfillment of the obligations related to maintaining cleanliness and order in areas outside the road lane within the administrative boundaries of the city of Bytom, imposed on the Ordering Party in accordance with Art. 5 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Dz. Journal of Laws 2024, item 399 late). 4. The subject-matter of the contract and the manner in which it is to be performed in each lot shall specify: a) Detailed description of the subject-matter of the contract with annexes (hereinafter referred to as the SOPZ) - Annex 1 to the FTZ b) Estimated quantities - Annex 1.1 - 1.5 to the FTZ c) Draft provisions of the contract - Annex 2 to the FTZ. 5. The contracting authority accepts the possibility of submitting partial tenders for 5 parts of the procedure. 6. The offer can be made in 5 parts. 7. The Contracting Authority shall not limit the number of lots which it may award to a single Contractor. 8. The Ordering Party does not require the submission of an offer in the form of an electronic catalogue. 9. Prior to the initiation of the procedure, the contracting authority did not conduct preliminary market consultations. 10. The contracting authority does not provide for variant offers. 11. The contracting authority shall allow the procedure to be cancelled if the public funds which it intended to use to finance all or part of the contract have not been awarded to it. 12. Requirements for joint bidders to submit a tender: Pursuant to Article 58 of the Public Procurement Act, Contractors may apply jointly (consortia, civil law partnerships). If the Contractors jointly apply for the award of the contract, the Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude the public contract (this shall not apply to a civil-law partnership if the Contractors attach to the tender the articles of association from which the power of attorney to act on behalf of the company will result, or all partners will sign the tender). To the extent not regulated by the FTZ, the provisions of the Regulation of the Minister for Development, Labour and Technology of 23 December 2020 on subjective means of proof and other documents or statements that may be requested by the Ordering Party by subcontractors (Journal of Laws 2020, item 2415) shall apply. 13. The contracting authority provides for the award of contracts consisting in the repetition of similar services referred to in Article 214(1)(7) of the Public Procurement Act. 16. The contracting authority shall carry out the procedure itself. 17. The notice does not concern a contract for social and other specific services. 18. The contracting authority does not provide for the requirements referred to in Article 94 of the Public Procurement Law. 19. The contracting authority does not provide for the means of proof in question. 20. The Contractor declares that he meets the requirements set out in Articles 28, 29, 30, 32, 33 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, in particular: a) ensure that it applies technical and organisational measures to ensure the security of the personal data transferred, b) ensure that access to the personal data entrusted is only granted to authorised persons to whom the Contractor has instructed the processing of personal data, c) ensure that access to the premises where the entrusted data are processed is only granted to authorised persons and that access to these premises is supervised, d) ensure that the systems, applications and IT equipment used to process the entrusted data are secured against unauthorised disclosure or loss of the entrusted data, e) ensure that the connection to the remote access to the IT system is secured by an encrypted channel, f) ensure that it will cooperate with the controller in order to exercise the rights of the data subjects referred to in Chapter III of this Regulation, g) ensure that it will immediately inform the controller of personal data breaches and cooperate with the controller to the extent necessary to fulfil the obligations related to the personal data breach incumbent on the controller under this Regulation. The contractor declares that it maintains documentation confirming the above activities and that it will make the indicated documentation available at the request of the administrator.
