Supply of brake linings
1.The subject of the order is the factory supply of new 5000 sets of brake linings type Jurid 878 (J1492/J1493) Fig. C105255/35B5X or equivalent, for use in EZT series 45EC and Pesa Sundeck double-decker wagons. Equivalent linings must be approved for use in the above-mentioned vehicle type and wagons, have identical functions and parameters, and their use will not require authorisation to place the EZT 45EC series vehicle and Pesa Sundeck double-decker wagons on the market. 2.One set of linings consists of 2 (two) brake linings – right and left. 3. The contracting authority requires that the subject of the contract has: 1) UIC certificate, in accordance with the UIC 541-3 standard, issued for the offered type of brake lining, 2) technical drawing of the offered type of brake lining, 3) product card, taking into account the basic technical parameters of the offered brake linings. 4. In all provisions of the FTZ and its annexes, which refer to standards, technical assessments, technical specifications and technical reference systems, in accordance with Art. 4 of the Public Procurement Act, the Employer allows the use of equivalent solutions, standards, technical assessments, technical specifications and technical reference systems, indicated in the SWZ and annexes if they allow to obtain features or parameters not worse than those referred to. Where equivalent solutions are applied, the Contractor shall be required to demonstrate in writing the equivalence of the technical parameters offered in relation to the subject-matter of the contract. The contractor shall prove in the tender, in particular by the means of evidence referred to in Articles 104-107 of the Public Procurement Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent extent. 5. The Contracting Authority shall request the submission of the measures of evidence referred to in Section IV para. 1 points 1)-3) of the FTZ, in Chapter IV, para. 3 SWZ (if applicable). If the Contractor fails to submit the evidence in question or the evidence in question is incomplete, the Contracting Authority shall, in accordance with Article 107 para. 2 of the PPL Act shall request the Contractor to submit or supplement the evidence referred to in Section IV para. 1 points 1)-3) of the FTZ, in Chapter IV, para. 3 SWZ (if applicable). 6. If the Contractor intends to rely on the official certificate referred to in the Act of 5 August 2025 on the certification of public procurement contractors, he is obliged to indicate this in Part II, Section A, of the ESPD, stating: the number and designation of the certificate, the full name of the certifying entity that issued the document, the period of validity of the certificate and the exact scope of the exclusion grounds or conditions of participation for which the Contractor relies on that certificate.
