Transport of children and young people with disabilities will take place during hours enabling them to participate in classes in individual educational institutions, in accordance with the school schedule, on all school days, in the period from 01.09.2025 to 25.06.2027, except for public holidays, holiday breaks, winter holidays and closure of educational institutions. 5. Transport of children and young people with disabilities will be carried out from Monday to Friday. In the morning, the transport of children and young people with disabilities must be carried out from their home address to a given educational institution, and after classes from a given educational institution to their home address. 6. During the transport of children and young people with disabilities, only children and young people with disabilities who are transported to and from educational establishments may be transported in the vehicle, in addition to the person driving the vehicle (hereinafter referred to as the ‘driver’) and persons caring for the children being transported (hereinafter referred to as the ‘carers’). Carriage of other persons is possible after obtaining the consent of the Ordering Party. 7. The contracting authority informs that it allows the mileage and number of transport routes specified in the description of the subject of the contract to be adjusted to the fleet of vehicles available to the contractor, provided that the other requirements indicated in the CVT and the draft contract are complied with. 8. Detailed information on the subject of the contract, including requirements for the provision of the service, the place of pick-up of disabled children and young people, the addresses of educational institutions to which disabled children and young people should be transported, recommended transport routes, their length and the number of courses provided, are specified in the description of the subject of the contract, constituting Annex 11 to the SWZ and in the draft contract, constituting Annex 1 to the SWZ. 9. The contracting authority pursuant to Art. 1 of the Public Procurement Act requires the employment by a contractor or subcontractor on the basis of an employment contract of persons directly related to the performance of driving activities and the care of transported children. Detailed requirements for the implementation and enforcement of the requirement of employment on the basis of an employment relationship are set out in the draft contract. 10. The Contracting Authority does not specify additional requirements related to the employment of persons referred to in Art. 2 point 2 of the Public Procurement Act. 11. The contracting authority does not provide for the award of contracts referred to in Art. 1 of the Public Procurement Act. 12. The subject-matter of the contract must be performed taking into account all accessibility requirements for persons with disabilities, as described in the draft contract and in the description of the subject-matter of the contract. 13. The contracting authority did not divide the contract into lots due to the fact that such division would risk excessive costs of contract performance taking into account the specificity of the contract. The need to coordinate the activities of the different contractors performing the different lots could seriously jeopardise the proper performance of the contract. Failure to divide the contract is dictated by technical, organisational and nature of the subject matter of the contract. Any division of the contract into lots would not increase competitiveness in the sector of small and medium-sized enterprises - the scope of the contract is typical, allowing tenders to be submitted to contractors from the group of small and medium-sized enterprises. 14. The subject of the contract must be performed in accordance with the provisions of the SWZ, the draft contract and the offer submitted by the contractor in the procedure. 15. The conditions for the provision of services and the terms of payment are set out in the draft contract. 16. Detailed requirements for the implementation and enforcement of the requirement of employment on the basis of an employment relationship are set out in the draft contract.
