Description

1. The subject of the contract is the provision of specialist care services. 2. The order was divided into two parts. The Contractor may submit a tender for any Lot (two Lots or one Lot). 3. The individual Lots of the contract concern: 3.1.Part 1 of the contract, the subject of which is the provision of specialist care services for people with aphasia from the area of Gdynia, hereinafter referred to as "the Service", as defined in the Act of 12 March 2004 on social assistance and the Regulation of the Minister of Social Policy of 22 September 2005 on specialist care services. The scope of Services includes teaching and developing skills necessary for independent living and preparation for undertaking specialist therapeutic support. The service will be provided to 10 persons, for a total of 780 hours during the term of the contract (i.e. an average of 78 hours per person). Persons to whom the Service will be provided will be indicated by the Ordering Party. The service will be provided on working days from Monday to Friday from 7:00 to 19:00 (it is permissible to provide services on Saturday, if all interested persons agree). 3.2. Lot 2 of the contract, the subject of which is the provision of specialist care services for children and adults on the autism spectrum, including Asperger’s syndrome from Gdynia, hereinafter referred to as ‘the Services’, as defined in the Act of 12 March 2004 on social assistance and the Regulation of the Minister for Social Policy of 22 September 2005 on specialist care services. The services will be provided in the amount of 14 400 hours during the term of the contract (average monthly 1200 hours), to 45 people per month, indicated by the Ordering Party, on working days from Monday to Friday from 7:00 to 19:00. It is permissible to provide the Services on Saturday, provided that both parties agree to it. 3.3. Attention! The Contracting Authority points out that the term "hours of provision of services" should be understood only as the actual time of provision of services. By the term "hour", the customer understands the clock hour, i.e. 60 minutes. The Contracting Authority reserves the right to reduce the expected number of hours of services provided, in particular depending on the number of people applying for the indicated form of assistance or incomplete securing of funds for the provision of services by the Pomeranian Voivode. The above-mentioned number of hours of services is maximum, while the minimum number of hours of services provided during the period of performance of the subject of the contract is 300 hours (part 1) and 9,000 hours (part 2). The Contractor shall not be entitled to order a full number of hours. In the case of ordering an incomplete number of hours, the Contractor will only be entitled to remuneration resulting from the services provided and he will not make claims as to the implementation of the remaining part. 4. Detailed information on the subject of the contract and the method of its implementation is set out in Annex 1 to the SWZ - Gdynia standard of specialist care services provided at the place of residence, hereinafter referred to as the Standard. 5. The contractor will be obliged to provide high-quality care services. 6. The description of the subject of the contract for Part 1 and Part 2 is also set out in the model contract, which constitutes Annex 2.1 for Part 1 and Annex 2.2 for Part 2 to the SWZ. 7. In the case of obtaining additional funds from external sources (e.g. EU programs, ministerial programs, funds from state funds) for the implementation of the subject of the contract, the Contracting Authority provides for the possibility of applying the option right, increasing the subject of the contract by an additional dimension of the hours of providing the Service, i.e. up to a maximum of 120 hours (for part 1) and 200 hours (for part 2). The Contracting Authority will indicate the final number of hours under the option to the Contractor by activating the option (the number of hours may be less than the maximum number indicated). However, the unit price of the hour of provision of the service under the option will be the same as the unit price of the hour of provision of the service offered by the contractor under the basic contract (in a given year). The right of option consists in the fact that the Ordering Party may order (one time, or several times) the purchase of additional hours of services provided (however, the term "hours of provision of Services" should be understood only as the actual time of provision of Services, the Ordering Party understands the clock hour, i.e. 60 minutes), provided that the Contractor has no claim against the Ordering Party if the Ordering Party does not exercise the option right.
