Description

1. The subject of the contract is a comprehensive service of municipal waste management received from owners of residential real estate, from the area of the municipality of Myszków. Municipal waste sent for management comes from owners of properties inhabited from single-family and multi-location buildings and is waste collected at the Selective Municipal Waste Collection Point at Prusa 70 in Myszków. 2. In order to enable waste management to be carried out in accordance with the requirements set by the Ordering Party for waste treatment processes, the Ordering Party divided the Order into 7 parts, taking into account the fractions of municipal waste received as part of a separate Order granted. 3. In view of the above, cf. The implementation of the municipality's obligation in the field of municipal waste management - waste management has been divided into the following parts: 1) Pt. 1 by Zam. - Management of waste collected from owners of properties residing in the municipality of Myszków: unsorted (mixed) waste, bulky, clothing and textiles, hazardous, expired medicines, batteries; 2) Part II. 2 by Zam. – Management (collection or treatment) of waste collected from property owners residing in the municipality of Myszków: paper, cardboard, metal, plastics, glass, multi-material; 3) Pt. 3 by Zam. - Management of waste collected from owners of properties residing in the municipality of Myszków: tyres; 4) Pt. 4 in order. - Management of waste collected from owners of properties residing in the municipality of Myszków: ash; 5) Part II. 5 for me. - Management of waste collected from owners of properties residing in the municipality of Myszków: waste electrical and electronic equipment; 6) Pt. 6 for me. - Management of waste collected from owners of properties residing in the municipality of Myszków: bio-waste; 7) Pt. 7 in order. - Management of waste collected from owners of properties residing in the municipality of Myszków: construction and demolition waste. 4. The above-mentioned annexes constitute an unambiguous and comprehensive description of the entire subject. 7. The Contracting Authority does not specify accessibility requirements for disabled persons, as waste treatment occurring in waste management processes determines the nature of this contract, in which the direct use of the installation concerns only the Contractor's employees. 8. Whenever the description of the subject-matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and sec. 3 of the Public Procurement Act, the Contracting Authority allows solutions equivalent to those described, and such a reference is accompanied by the words ‘or equivalent’. 9. Other information on equivalent solutions is described in Chapter II. 5 SWZ. 10. The Contracting Authority shall allow partial tenders to be submitted by the Contractors. In the procedure, the Contractor may submit a tender for the lot(s) of his choice, including all lots, but may submit only one tender for a given lot. 11. The Contracting Authority does not reserve the obligation to personally perform key tasks by the Contractor, in accordance with the procedure specified in Article 121 of the Public Procurement Act. 12. The Contractor may entrust the execution of part of the order to a subcontractor. 13. The Contracting Authority requests the Contractor to indicate in the tender the parts (ranges) of the order which it intends to entrust to individual subcontractors and to indicate the names of any subcontractors if they are already known. 14. For this purpose, the Contractor must provide the relevant information in the tender form, which constitutes Annex 8 to the SWZ. In case the Contractor does not intend to perform the contract with the participation of subcontractors, enter in the appropriate place in the table of the tender form "not applicable" or other similar wording. 15. Entrusting the execution of parts of orders to subcontractors does not release the Contractor from liability for proper execution of orders. 16. If the change or resignation of the subcontractor concerns an entity on whose resources the Contractor relied, in accordance with the principles set out in Art. 1 of the Act, in order to demonstrate compliance with the conditions for participation in the procedure, the Contractor is obliged to demonstrate to the Contracting Authority that the proposed other subcontractor or the Contractor independently complies with them to a degree no less than the subcontractor on whose resources the Contractor relied during the procedure for granting orders. 17. In this procedure, the Contracting Authority will not examine whether subcontractors that are not entities making resources available are subject to the grounds for exclusion set out in Chapter III. 7 SWZ. 18. The ordering party requests that before proceeding with the execution of the order. The Contractor has provided the names, contact details and representatives, subcontractors involved in the execution of the order, if known. The Contractor is obliged to notify the Contracting Authority of any changes to the information referred to in the first sentence during the execution of the order, and also provides the required information on new subcontractors to whom he intends to entrust the execution of the order at a later date. 19. In the present proceedings, the Contracting Authority does not allow: 1) submission of variant offers; 2) determining the price of the offer and settlement of remuneration in a currency other than PLN. 20.
