Description

1. The subject of the contract is the supply of spare parts for rail buses SA132, SA134, the type, description and terms of delivery of which are specified in Annex 2.1 - 2.2 (Price form) and Annex 4 (Model contract) to the SWZ. The subject of the contract has been divided into 2 Tasks with the following scope: 1) Task No 1 – Spare parts for SA132, SA134 – assortment and quantities are set out in Annex 2.1 to the SWZ. 2) Task No 2 – Spare parts for SA134 – assortment and quantities are set out in Annex 2.2 to the SWZ. 2. The parts offered must: - strictly comply with the requirements set out in Annex 2.1 - 2.2 to the SWZ, - be original, brand new, free from defects, meet the relevant quality requirements and the requirements of European standards or Polish Standards transposing European standards, as well as not encumbered by third party rights, - meet the requirements set out in the Model Agreement. 3. Contractors may apply for the award of a contract if they: 1) are not excluded in the circumstances referred to in Art. 1 of the Public Procurement Act, with the proviso that in the Proceedings the contractor is not excluded in the case referred to in art. 1 point 1 letter h of the Public Procurement Act, and in the case referred to in art. 1 point 2 of the Public Procurement Act, if the person referred to in this provision has been convicted of an offence listed in art. 1 point 1 letter h of the Public Procurement Act, in addition, are not excluded in the circumstances referred to in: - Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ EU L. of 2014, No 229, p. 1 as amended; hereinafter referred to as "Regulation 833/2014"), - Art. 1 of the Act of 13 April 2022 on special arrangements for counteracting the support of aggression against Ukraine and for the protection of national security (Journal of Laws No. Journal of Laws 2024, item 507; hereinafter referred to as the ‘Sanctions Act’); 2) meet the conditions for participation in the Proceedings specified by the Ordering Party.
