Description

1 The subject of the proceedings is the conclusion of framework agreements for the performance of an annual and/or five-year inspection in accordance with Article 62(1)(1) and/or (2) of the Construction Law Act of 7 July 1994 (Journal of Laws No. Journal of Laws of 2025, item 418) together with the assessment of the technical condition and safety of hydrotechnical facilities (only for 5-year inspections) in accordance with the Water Law of 20 July 2017 (Journal of Laws of 2024, item 1087 as amended) – pumping stations, erecting structures and flood barriers in the area of operation of ZZ Gorzów Wlkp. (for part 1) and in the area of operation of ZZ Poznań (for part 2) together with the preparation of reports on the checks carried out. 2 The purpose of the present procedure is to conclude two framework contracts for the provision of services, one for a given part of the procedure, between the Contracting Authority and a maximum of five Contractors for a given part, in order to determine the terms of contracts that may be awarded within 36 months from the date of signature of the framework contract, hereinafter referred to as ‘partial contracts’. 3 Pursuant to Article 7(26) of the Public Procurement Act, a framework contract is to be understood as a contract concluded between the Contracting Authority and one or more Contractors, the purpose of which is to determine the conditions relating to contracts that may be awarded during a given period, in particular the prices and, if necessary, the quantities envisaged; 4 The scope and type of work to be carried out under the subject-matter of the contract for individual lots (objects) are set out in the annexes:  Description of the subject-matter of the contract;  Schedules - separately for each part (as supporting document and annex to the CIP) The amounts of checks indicated in the Schedules are indicative and serve only for the purpose of comparing offers; 5 Information on the conditions for concluding the Framework Agreement: two (2) framework contracts shall be concluded for the contract (for each lot separately) in order to determine the terms of the contracts which may be awarded within a period of 36 months from the date of signature of the framework contract; b) on the basis of the Framework Agreement, the Employer will award Partial Orders to Contractors, within the framework of Partial Agreements. The scope of Partial Agreements will be determined according to the needs of the Ordering Party; c) The framework contract shall be concluded for each lot separately between the Contracting Authority and a maximum of five (5) Contractors whose tenders prove to be the most advantageous on the basis of the criteria for evaluating tenders set out in point 15 of the FTZ, unless less Contractors have submitted non-rejectable tenders; d) The Contracting Authority will award Partial Contracts, the subject of which is covered by the Framework Agreement, to Contractors with whom it has concluded the Framework Agreement, under the conditions specified in the Framework Agreement (in accordance with the provision of Art. 1 point 2 of the PPL Act); e) The Ordering Party reserves that it does not guarantee the ordering of Partial Orders for the amount of the maximum remuneration indicated in the Framework Agreement and for this reason the Contractor is not entitled to any claim;
