Description

The procedure is conducted in accordance with the Public Procurement Law Act of 11 September 2019 (Journal of Laws 2026, item 793), hereinafter referred to as the Public Procurement Act, the Contracting Authority awards the contract in lots, each of which is the subject of a separate procedure. Public procurement procedure for the conclusion of a framework agreement. The framework contract shall be awarded by means of an open tendering procedure pursuant to Article 311 para. 1 point 1 in conjunction with Article 132 of the Public Procurement Law Act of 11 September 2019 (Dz. Journal of Laws of 2026, item 793). The procedure is conducted with a view to concluding a framework contract with a single Contractor, in accordance with Article 313 sec. 1 of the PPL Act. The contracting authority provides for the possibility of a single renewal in Parts I and II of the contract for a further period of 24 months. Renewal consists in the performance of the same service (with the same material scope) on the same contractual terms specified in the contract, requires the consent of both the Ordering Party and the Contractor (it does not require the conclusion of an annex to the contract). The value of a single renewal ‘is imposed top-down’, as the same as the value of the basic contract and is calculated on the basis of the indicated unit prices. The detailed description of the subject of the contract is set out in Annexes 1, 1.1 - 1.2 and No 4 to the FTZ, i.e.: Offer form with assortment and price specifications and draft provisions of the contract. The indicative scope and the quantities of the subject-matter of the contract are set out in Annex 1.1. – 1.2. the content of the FTZ, drawn up on the basis of anticipated, indicative (maintenance and repair) needs in 2026, 2027 and 2028. The contracting authority is not aware of the exact quantity, type and timing of its needs to be met in the future. The Ordering Party reserves the right to order deliveries of the assortment in quantities smaller or greater than the indicative quantities indicated in Annexes.1.1 to 1.2. of the FTZ, depending on actual needs, provided that the total value of the Contractor's remuneration for the performance of the contract may not exceed the value of the remuneration specified in the contract. The Ordering Party allows partial tenders, each of which will be assessed by the Ordering Party separately, in accordance with the rules described in the FTZ. The contract was divided into lots as described in Annexes 1.1. – 1.2. to the FTZ. Each Contractor may submit an offer for any selected part/parts. The contracting authority shall require the submission of a tender for all required items listed in Annexes 1.1. – 1.2. to the FTZ. Whenever, in this FTZ, the subject-matter of the contract is described with an indication of the trade marks, patents or origin, source or specific process which characterises the products supplied by a particular Contractor, if this could lead to the preference or elimination of certain economic operators or products, such indications shall be deemed to be accompanied by the words ‘or equivalent’. The contracting authority, describing the subject of the contract, on the basis of the instruction expressed in Art. 4 of the Public Procurement Act, indicated the trademark or origin due to the specificity of the subject of the contract and the inability to describe it exhaustively using accurate and intelligible terms. Describing the subject of the contract by means of trademarks, patents or origin, source or a specific process that characterizes the products delivered, the Ordering Party thus determines the quality, technical and functional parameters that the subject of the contract must meet in order to meet the requirements set by the Ordering Party.
