Description

1. The subject of the contract is the supply of infrastructure elements of edge nodes. 2. Detailed requirements concerning the subject-matter of the contract are an integral part of the description of the subject-matter of the contract and are included in Part IV of the FTZ. 3. The contractor is obliged to provide the contracting authority with a quality guarantee. The warranty requirements are set out in Parts III and IV of the FTZ. 4. The warranty period will be counted from the date of preparation of the delivery and acceptance protocol of the subject of the contract. 5. The delivered subject of the order must be brand new, unexposed at exhibitions, complete and technically efficient. ‘Factory new’ means the subject-matter of the contract originally packaged, not used before the date of delivery, excluding the use necessary to carry out the test of its correct operation after production. 6. The subject of the contract must be free from any physical and legal defects and claims of third parties. 7. The delivered subject of the contract must come from the distribution channel of the manufacturer not excluding distribution to the Polish market and ensuring the implementation of warranty rights. 8. The subject of the contract must be delivered together with operating instructions, controllers and any accompanying software necessary for the proper use of the subject of the contract (obtaining full functionality indicated in Part IV of the FTZ). The contracting authority will not be obliged to pay any additional fees, in particular royalties, and any licenses will be granted as part of the contractor's remuneration, without any time and territorial limitation, unless otherwise expressly stated in Part IV of the FTZ. If licenses, codes or other permissions are needed to run and use this software, they must be provided at no additional charge. Codes, licenses and other permissions must also be provided when they are necessary to run or configure hardware components. 9. The supplied subject of the contract for mains power supply must be equipped with an adequate number of power cables to connect it to standard power outlets, unless otherwise specified in Part IV of the FVC. 10. The subject-matter of the contract offered on the date on which the tender is drawn up may not be provided for by the manufacturer to be withdrawn from production or sale. 11. The subject-matter of the contract offered must bear either a CE conformity marking (CE mark) or a declaration of conformity with CE. Where the offered subject-matter of the contract is not subject to the CE marking obligation, the subject-matter shall have a declaration of compliance with the RoHS Directive or be marked with the RoHS mark, the items to which the marking relates are listed in Part IV of the FTZ. 12. The offered subject of the contract - equipment, and if justified by the size or function of the equipment - on the packaging and documents accompanying the equipment, must be marked with a separate collection symbol (crossed out container) - the items to which the marking applies are listed in Part IV of the FTZ. 13. The subject-matter of the contract offered must include information on reuse and recycling. Computing servers provided must not contain paints and coatings on large plastic parts that cannot be recycled or reused. All components containing electronic components and hazardous components should be removable. Removal of materials and components should be carried out in accordance with the requirements of the WEEE Directive 2002/96/EC. Each computing server must consist of at least 65% reusable/recyclable components. All plastic parts (assortment/components to be procured) heavier than 25 grams may contain only traces of flame retardants classified in Directive RE 67/548/EEC.
