‘SUPPLY OF MEDICAL AND SURGICAL INSTRUMENTS FOR COPERNICUS PL SP. Z O.O.’
1. The subject of the contract is the supply of tools for medical and surgical procedures for Copernicus PL Sp. z o.o. 2. The subject of the contract was divided into 44 lots. 3. Item name according to the Common Procurement Vocabulary: 33169000-2 Surgical instruments. 4. A detailed description of the subject-matter of the contract, specifying the Ordering Party’s requirements and quantities, is contained in Annex No 1 to the SWZ – Assortment and Price Form and in Annex No 5 to the SWZ – Draft contract. By completing the items indicated in Annex 1 to the FTZ, the Contractor confirms compliance with the requirements specified by the Contracting Authority. 5. Offered items of the order must be allowed to be marketed and used in accordance with applicable law. 6. Offered items of the order must be complete, of a high standard in terms of both quality and functionality, as well as free from defects in materials, construction and legal. 7. The subject of the contract must comply with the Medical Devices Act of 7 April 2022 (Journal of Laws 2022, item 974 as amended) – if applicable. 8. In all provisions of the FTZ and its annexes, in which the Contracting Authority refers to standards, approvals, technical specifications or reference systems or indicates trademarks, parameters or sources of origin (names of manufacturers or equipment), in accordance with Art. 5 and Article 101 para. 4 of the PPL Act, the Employer allows equally valid solutions. 9. The concept of ‘equivalence’ of a solution shall, in particular, be understood to mean: an indication that the solution offered has at least the same or better technical characteristics and functional quality characteristics, as described by the standard, type or mark in question, which relate to the performance values of the subject-matter of the contract, relevant to the material, component or product used, such as: functionality, performance, strength, durability, resistance, ease of use, safety, comfort of use, standard of finish and features that describe the physical properties of the subject-matter of the contract, such as size (length, width, height), volume, density, shape, colors, structure, type of material and component. The Contractor who relies on equivalent solutions is obliged to demonstrate that the supplies, services or works offered by him meet the requirements specified by the Contracting Authority. 10. The Contracting Authority does not reserve the possibility of applying for the contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 11. The Contracting Authority does not impose the requirements referred to in Article 96 of the Public Procurement Act. 12. In connection with the performance of the contract, the Ordering Party does not provide for the obligation to personally perform the key tasks of the contract.
