Description

The contracting authority will award the public procurement contracts following the framework agreement in the house only in compliance with the technical and financial conditions laid down in that framework agreement.
Each time it intends to award a subsequent public procurement contract to a framework agreement, the contracting authority will consult with the economic operator in the first position in the ranking, asking it, depending on the need, to complete the tender.
If the economic operator in the first position in the ranking is unable to supply the entire quantity of products required and/or cannot comply with the delivery deadlines, the contracting authority shall be entitled to submit a request for the award of the subsequent contract to the second economic operator on the basis of the prices tendered for the lot in question. Consequently, the second operator is unable to supply the entire quantity of products needed and/or to comply with the delivery deadlines by sending a request for the award of the subsequent contract to the third operator, i.e. 4 and 5 with which the contracting authority concluded the framework agreement.
