Description

The subject of the order is service of XEROX printing systems. The procedure is conducted in an open tender procedure in accordance with Article 132 of the Public Procurement Act. The contracting authority shall award the contract in lots, each of which shall be the subject of a separate procedure. A detailed description of the subject of the contract shall specify: Annexes No: 1, 1.1., and 4 to FTZ, i.e.: Offer form with assortment and price specifications and draft provisions of the contract. The CONTRACTOR does not allow the submission of partial tenders. Justification: in deciding not to split the contract into lots, account was taken of: the specificity of the contract, additional technical difficulties, costs and risks associated with the coordination of several economic operators. The decision is optimal from the end-user's perspective. In the procurement procedure, communication between the CONTRACTOR and the CONTRACTORS, in particular submission of tenders, exchange of information and transmission of documents or declarations, takes place using electronic means of communication provided by the System. The technical and organizational requirements for sending and receiving electronic documents and information provided using them are described in the Regulations for the use of the System services (Regulations of the e-Services Portal) available from the E-learning module for all users of the System and during the registration of the account of the CONTRACTOR for the CONTRACTORS. Offer, statements (EDZ) submitted electronically must be signed with an electronic qualified signature. In the process of submitting an offer, statements or evidence on the platform, the qualified electronic signature of the CONTRACTOR may be placed directly on the document, which is then sent to the System. The attestation of conformity shall be made by the CONTRACTOR, the CONTRACTOR jointly applying for the award of a public contract, as appropriate, in respect of the documents relating to each of them. The original should be understood as a document signed with a qualified electronic signature by an authorised person(s). The attestation of conformity with the original shall be made in electronic form, signed by a qualified electronic signature by the authorised person(s). The CONTRACTOR provides for the possibility of resuming the order once for a further period of 24 months. Renewal consists in the performance of the same service (with the same material scope) under the same conditions specified in the Draft provisions of the contract, requires the consent of both the CONTRACTOR and the CONTRACTOR (it does not require the conclusion of an annex to the contract). The value of a single renewal ‘is imposed top-down’, as the same as the value of the basic contract and is calculated on the basis of the indicated unit prices. During the renewal period, the provisions of the Draft provisions of the Agreement shall apply. The CONTRACTOR does not reserve the possibility of applying for a contract only by the CONTRACTORS referred to in Art. 1 of the Public Procurement Act, i.e. social cooperatives and other contractors having the status of sheltered workshops, whose main purpose or the main purpose of the activities of their organisationally separate units that will carry out the contract is the social and professional integration of socially marginalised people. The CONTRACTOR requires full-time employment by the CONTRACTOR or SUBCONTRACTOR on the basis of an employment contract of at least 2 (two) persons performing activities in the field of contract performance, i.e.: servicing of equipment, if the performance of these activities consists in performing work in the manner specified in Article 22(1) of the Labour Code Act of 26 June 1974.
