Description

1. The subject of the contract is the supply of medicinal products for UCK in the assortment, estimated quantity and requirements specified in Annex 3 to the FTZ. 2. The contracting authority shall allow partial tenders to be submitted. Partial tenders are understood as individual parts set out in Annex 3 to the ToR. The Contractor may submit an offer for one or more lots. 3. Within the scope of Part 1, the Contracting Authority shall allow partial tenders to be submitted. Partial tenders are understood as individual items set out in Part 1 of Annex 3 to the ToR. The Contractor may submit an offer for one or more items. 4. As part of the items marked in the assortment-price form with the symbol (**) in Annex 3 to the SPC, the Contracting Authority requires that the product offered be included in the catalogue of reimbursed medicines used in drug programmes or in the catalogue of reimbursed medicines used in chemotherapy. 5. The ordering party specified the packaging method in the assortment and price form. In items where there is no such description, the Contractor may offer any method of packaging in accordance with the quantity required by the Ordering Party specified in the item. The contractor must estimate the proposed packaging method with an appropriate conversion. 6. Deliveries will be made successively, in quantity and assortment, in accordance with the Ordering Party's partial orders within 2 days from the date of placing the order. The contracting authority requires that the prices of medicines offered are not higher than the official prices referred to in Art. 1 and 2 of the Act of 12 May 2011 on the reimbursement of medicines for foodstuffs intended for particular nutritional uses and medical devices (Journal of Laws 2024, item 930), in force on the day on which tenders are submitted, if any. 8. The medicinal products offered must comply with the Pharmaceutical Law Act of 6 September 2001 (Journal of Laws No. 101, item 926, as amended). Journal of Laws 2024, item 686), if applicable. The medicinal products offered must be authorised for marketing in Poland in accordance with the rules set out in Article 3 or 4a of the Pharmaceutical Law Act. 9. The contracting authority shall allow the submission of an equivalent tender in respect of items 129, 149, 165, 297, 305, 366, 376, 429, 459, 460, 461. The Ordering Party informs that all proper names used in the description of the subject of the contract determine the required standard of the ordered assortment. The Ordering Party allows submission of tenders with equivalent quality parameters, having the same chemical composition in terms of basic substances. Proof of the fulfilment of the equivalence condition shall lie with the Contractor. 10. In the event that the Ordering Party used in the description of the subject of the contract the indications of standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the PPL Act, equivalent solutions are allowed. Whenever a standard is indicated in this FTZ or in the annexes to the FTZ, it must be assumed that the term ‘or equivalent’ is used in relation to it.
