Description

The purpose of this consultation is to award a service contract for the operation of the drinking water production facilities at SIDEAU Moret Seine and Loing. The attention of economic operators is drawn to the fact that the Syndicate, by deliberation No 2024.09.26 of 25 September 2024, on the one hand, approved the principle of delegation of the service of production and distribution of drinking water by means of leasing and authorized the President to launch and conduct the procedure provided for by the provisions of the articles of the General Code of Local Authorities (CGGT) and on the other hand, recorded the principle of direct management of the service of production of drinking water via outsourcing by a public service contract and authorized the President to conduct in parallel the procedure provided for by the provisions of the articles of the Code of Public Order (CCP). In the same resolution, the Syndicate noted that the choice of service management method would be final only at the end of the consultation procedures carried out at the same time and before the award of the contract or contracts envisaged; this solution allows the Syndicate to determine, in full knowledge of the facts, the interest of favouring a complete delegation of the public drinking water service or a separation of management methods for the production and distribution of drinking water, making it possible to study in parallel the competitive consequences, operationally and financially, of the two management methods envisaged. Thus, economic operators are informed of the possibility for the Syndicate to declare, at any time, the present consultation procedure without further action, in accordance with Article R. 2185-1 of the CCP, on the ground that it would be appropriate for the Syndicate to favour a complete delegation of its public drinking water service, without giving right to any compensation to the economic operators who participated in the present procedure.
