1. The subject of the contract is the supply of 6 electric buses with a length of up to 10.0 m, brand new, identical, manufactured by one manufacturer not earlier than 6 months before the delivery date, with a mileage of no more than 500 km. The Ordering Party allows a mileage greater than 500 km if the bus will be transported on wheels, but not more than 500 km increased by the distance from the Contractor's factory to the Operator's depot (ul. Słowicza 59, 43-400 Cieszyn) – calculated according to the Google Maps application. 2. Buses must meet the conditions set out in Regulation (EU) 2019/2144 of the European Parliament and of the Council (GSR2 – General Safety Regulation 2). 3. All delivered buses must have the necessary documents allowing their registration and operation in accordance with the intended use on the territory of the Republic of Poland. 4. Buses cannot be a prototype product. 5. The subject of the contract will be performed by the Contractor in accordance with the Description of the subject of the contract, which is attached as Annex 2 to the FTZ. 6. The contracting authority shall require the provision of a guarantee for the subject-matter of the contract carried out in accordance with the following periods: a) a minimum of 3 years full-vehicle warranty for buses, without a mileage limit, b) 8 years warranty for external paint coatings of buses, c) 10 years warranty for the body frame and for corrosive perforation of the exterior plates of buses, d) a minimum of 6 years for energy storage (batteries). 7. The contractor must ensure the availability, for a period of at least 15 years, of the necessary spare parts to ensure the operation of the buses. 8. The subject matter of the agreement will be implemented in accordance with the DNSH principle (‘do no significant harm to the environment’) for the following environmental objectives: 1) "Climate change mitigation"; 2) "Adaptation to climate change"; 3) "Sustainable use and protection of water and marine resources"; (4) ‘Circular economy, including waste prevention and recycling’; 5) ‘Prevention and control of air, water or soil pollution’; 6) ‘Protection and restoration of biodiversity and ecosystems’. 9. Remuneration will be payable after completion of the entire subject of the contract. 10. Detailed conditions for the performance of the contract are set out in the draft contract constituting Annex 11 to the FTZ. 11. The contracting authority in accordance with Art. 1 point 4) of the PPL Act, rejects the offer in which the share of products originating in the Member States of the European Union, countries with which the European Union has concluded agreements on equal treatment of entrepreneurs, or countries to which the provisions of Directive 2014/25/EU apply by virtue of the Council decision, does not exceed 50%.
