Description

The reasons for public procurement are that it is impossible to award the contract to another person due to the existence of rights acquired by operation of law. According to Article 39 (1) (2) of the Energy Act, the transmission of thermal energy is an activity subject to licensing. According to Article 43 (2) (3) of the same Act, only 1 heat transmission licence is issued for 1 separate territory. This leads to the conclusion that the supply of heat in a specific territory is an activity which can be carried out only by specific persons. It is apparent from the reasons given and the register of licences issued for energy activities that Toplofikatsia Sofia EAD holds licence No L – 05/15.11.2000 for the transfer of heat from the KEVR to the territory of Sofia with a duration of 20 years.
