2. New equipment and accessories, year of manufacture: No later than 2015, instructions for use in Polish.
3. The term of validity of the tendered subject of the contract shall not be less than 12 months.
4. The description of the characteristics, the safety rules, the expiry dates and the registration certificate number must appear on the packaging if this indication complies with the relevant legislation.
5. The contractor must deliver the subject of the contract to the Contracting Authority at risk and cost.
6. Original product – materials understood to have been produced from scratch by the relevant manufacturer of medical equipment, which have been developed together with equipment and supports to ensure optimal quality, efficiency and reliability of the equipment and to ensure that the guarantee conditions of the manufacturer of medical equipment are met. The materials must have all the legal attestations and tests required. Originally packaged with manufacturer-specific security features (e.g. holograms), with a description on the packaging unambiguously identifying the product, the manufacturer’s brand name, product code, type and model of equipment for which the material is intended.
Replacement product (equivalent) means a product compatible with the equipment for which it is procured with technical, quality or functional characteristics and standards the same or better than the original materials indicated in the description of the subject-matter of the contract but bearing a different trademark, patent or origin. At the same time, it shall be unremanufactured and shall not have recycled components or components previously used or modified.
Where the Contractor offers a replacement product (equivalent to) the materials required by the Contracting Authority, the burden of proof of equivalence shall lie with the Contractor.
7. Medical devices offered must comply with the requirements laid down in the Medical Devices Act of 20 May 2010 (Journal Of Laws 2010, No 107, item 679 as amended).
