Description

The offered subject of the contract must have the CE marking, be in accordance with the requirements of the Ordering Party described in the tender specifications and with the provisions of law in force in Poland, have the required declarations of conformity, attestations, certificates of registration, certificates of release for free circulation and use in Polish health care institutions on the basis of the applicable provisions of law. The expiry date of the offered subject of the order must be not less than 80% of the expiry date from the date of placing the order. A detailed description of the subject of the order, including the quantity and parameters, is contained in Annex 2 to the FTZ. The contracting authority accepts the possibility of submitting partial tenders, provided that the tender in each lot must be complete, i.e. include all items. Each lot is a separate subject of the contract and will be subject to a separate procedure related to the examination, evaluation and selection of the tender. Part 1 – Single-use medical equipment Part 2 – Single-use small medical equipment Part 3 – ECG electrodes Part 4 – Dressing materials The Contractor may submit a tender for one, several or all parts of the contract. If the Customer indicates in the description of the subject of the contract trademarks, patents or origins, sources or a specific process that characterizes the products or services provided by a particular Contractor, it is allowed to offer solutions equivalent to those described, provided that they maintain the same minimum technical, quality and functional parameters. Where reference is made in the description of the subject-matter of the contract to standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the Employer allows solutions equivalent to those described. The Contractor who invokes equivalent solutions is obliged to demonstrate that the solution offered by him meets the requirements specified by the Ordering Party. In such a case, the Contractor shall attach to the tender a list of equivalent solutions, together with its description or standards. In order to confirm that the offered deliveries meet the requirements specified by the Ordering Party, the Ordering Party requires the following means of proof to be submitted with the offer: descriptions, photographs, folders or catalogues for each item of Annex 2 to the FTZ. The Contracting Authority informs that in the event of failure to submit the evidence in question together with the offer or in the event that the evidence in question is incomplete, the Contracting Authority will call for it to be submitted or supplemented within the prescribed period. The agreement will be valid for a period of 24 months. The Ordering Party requires that the subject of the order be delivered on a fixed day of the week (Monday to Friday) from 7.30 to 14.00, by own transport, at its own expense to the Medical Supplies Department of the WSPR at ul. Fr. R. Markwarta 8 in Bydgoszcz, depending on the needs of the Ordering Party. The contracting authority provides for amendments to the contract on the basis of Art. 1 point 1 of the PPL Act. The Ordering Party provides for the possibility of extending the duration and performance of the contract by 12 months in a situation where, 21 days before the original end date of the contract, its performance does not exceed 50% of the value of the submitted offer and the probability of the Ordering Party purchasing the minimum quantity/value specified in § 4 sec. One contract, it's negligible. The tender must meet all the conditions and requirements contained in the FTZ and should contain the required documents, annexes, declarations listed in this FTZ, i.e.: 1) the tender form (Annex 1 to the FTZ), 2) the price form (Annex 2 to the FTZ), 3) the Single European Procurement Document (Annex 3 to the FTZ), 4) the declaration of the contractor/contractor jointly applying for the contract (Annex 4 to the FTZ), 5) the declaration of the entity making the resources available – if applicable (Annex 5 to the FTZ), 6) the commitment of the entity making the resources available – if applicable (Annex 8 to the FTZ), 7) the power of attorney document – if applicable, 8) the security lodged in the form of a bank guarantee, insurance guarantee or surety – if applicable, 9) the means of proof in question. The tender should be prepared in Polish in electronic form and marked with a qualified electronic signature in the data format consistent with the Notice of the Prime Minister of 9 November 2017 on the announcement of the consolidated text of the Regulation of the Council of Ministers on the National Interoperability Framework, minimum requirements for public registers and the exchange of information in electronic form and minimum requirements for ICT systems. The contracting authority recommends the use of the following formats: .pdf, .doc, .docx, .xls, .jpg (.jpeg) with particular reference to .pdf. In order to compress data, the Ordering Party recommends the use of one of the following formats: .zip, .7Z. All statements and documents drawn up in foreign languages must be submitted together with translations into Polish. The tender and declarations must be signed by a qualified electronic signature, by the person(s) authorised to represent and submit declarations of intent on behalf of the Contractor, as recorded in the relevant register. If the authorisation to sign the tender, represent the Contractor in the proceedings and incur obligations in the amount corresponding to the price of the tender results from a power of attorney, it should be attached to the tender in the form of an original electronic document and signed with a qualified electronic signature by the person(s) entitled in accordance with the entry in the relevant register.
