Description

The subject of the contract are services: maintaining cleanliness in the office buildings of the KOWR Te-rain Branch in six locations, maintaining cleanliness in their surroundings (including sweeping, walking, snow removal of paved surfaces, mowing lawns and raking leaves) and delivery and ongoing replenishment of materials and hygiene products. A detailed description of the subject-matter of the contract is set out in the Annex to the contract ‘Description of the subject-matter of the contract’. The subject matter of the contract was divided into 6 separate lots (objects of the contract). The subject-matter of the contract may not be divided by the Contractors, tenders not containing the full scope of the subject-matter of the contract specified in the partial task will be rejected. Pursuant to Article 121 of the Public Procurement Law, the Contracting Authority reserves the obligation for the Contractor to personally perform key parts of the contract. The key part of the contract for the Ordering Party are activities related to maintaining cleanliness in the office building, specified in the annex to the contract ‘Description of the subject of the contract’, excluding activities: 1) which, according to the content of the Description of the subject of the contract, are to be performed: once a month, once every quarter, once every six months, once a year, 2) related to maintaining cleanliness in the surroundings of the building, 3) related to the supply of cleaning and hygiene products. The key parts of the contract shall be performed by at least: 1) five employees (2 employees - east wing of the building - "A" wing and 3 employees - west wing of the building - "B" wing) - subject of 1 contract; 2) two employees – items 4-5 of the order; 3) one employee – items 2-3 and 6. Before proceeding with the submission of tenders, the Ordering Party recommends that an on-site inspection be carried out on the properties covered by the contract. The contracting authority pursuant to Art. 1 of the Public Procurement Law requires that the subject of the contract be carried out by persons employed on the basis of an employment contract within the meaning of the Labour Code Act of 26 June 1974, subject to. The obligation to employ employees on the basis of an employment contract does not apply to persons carrying out activities: 1) which, according to the content of the Description of the subject of the contract, are to be performed: once a month, once every quarter, once every six months, once a year; 2) related to maintaining cleanliness in the surroundings of the building, 3) related to the supply of cleaning and hygiene products. The other conditions for the performance of the contract are set out in the Annex to the contract ‘Description of the subject matter of the contract’ and in the draft provisions of the contract, which will be incorporated into the content of the contract, which are attached as Annexes 8 to the CVT.
