PL-Bydgoszcz: legal services
Permanent legal services will be provided to the Contracting Authority in all legal matters (fields) arising from the contracting authority’s activities, in particular legal aid and legal advice, so that the parties understand all activities and matters indirectly, for example those relating to legal advice and consultation, ongoing advice, legal advice, preparation of draft contracts, drafting of procedural documents, analysis and verification of contracts from a formal and legal point of view, verification of the company’s internal acts, representation of the Principal in proceedings before tax inspection and tax authorities, in registration, arbitration, arbitration and mediation procedures and during negotiations and negotiations, presence and cooperation with notaries’ offices and other legal offices, as well as legal and procedural representation and representation of the Principal in proceedings (including civil and criminal) before the ordinary courts of all instances, the Supreme Court, administrative courts, administrative bodies, enforcement bodies and other public administration bodies. In addition, as requested by the Principal, attending meetings of the Principal’s bodies and other meetings for which legal representation or legal consultation is required and other activities according to the Principal’s legal needs.
The subject matter of the contract will cover, in particular, the following areas of law: civil law, including commercial company law labour law, Public Procurement Law Construction Law, Financial Law on Housing Law other branches of law, relating to the Contracting Authority’s activities.
Contract performance conditions:
The Contractor must remain available (ready to provide services) to the Contracting Authority on working days (in principle Monday to Friday) from 08:00 to 16:00, in particular by ensuring that on those days and hours there is substantive contact with advisers or lawyers at the office of the firm in the city of Bydgoszcz. The contractor will be required to maintain permanent contact with the Contracting Authority and provide ongoing advice also to the Contracting Authority within the framework of the so-called ‘legal titles’:
(a) at the premises of the Contracting Authority’s Management Board, where necessary, and at least once a week,
(b) at the premises of the Contracting Authority’s Investigation Unit – if necessary, as a general rule once a week.
The estimated amount of benefits per calendar month determined on the basis of data from the two preceding years shall include 400 hours of work. The estimated number of cases referred to a law firm in one calendar month (for the purpose of management and representation) based on data from the two preceding years is 160.
The Contractor undertakes to carry out the tasks assigned to him within the time limits agreed on an ongoing basis when commissioning a specific service, it being understood that the Contracting Authority may not impose time limits shorter than:
— day-to-day counselling – 1 hour,
— verification of typical contracts and legal acts – 1 working day,
— legal opinions in complex cases – 3 working days,
— the Principal’s legal representation in court proceedings, in particular the lodging of the claim, the application – 7 working days.
The above time limits shall be calculated from the date on which the relevant order was sent to the Contractor, together with the information, documents, etc. required for its execution. A minimum deadline for notifying (advance) meetings during which the Service Provider will provide legal assistance (assistant) is set at 1 working day.
