Description

1. The contract shall comprise: 1) basic scope - preparation of design documentation, including in particular: assessment of the technical condition, concept, construction and executive design for the task entitled: Reconstruction of the Sztynorcki Canal, Węgorzewo municipality, Węgorzewski district, Warmińsko-Mazurskie voivodeship, together with the necessary scope of geological surveys, surveys and surveying materials, inventory of the existing state, inventory of greenery, complete materials for applications allowing obtaining a decision on environmental conditions for consent for the implementation of the project, location decision for a public purpose, water permit decision; building permit decisions and other agreements required at the stage of contract performance. 2) the scope covered by the right of option (optional scope) – performing author's supervision over the execution of construction works, performed on the basis of design documentation. 2. The detailed scope of the contract is specified in the description of the subject of the contract - Annex 4 to the SWZ 3. The contracting authority shall not allow partial tenders to be submitted. The contracting authority does not divide into parts for the reasons indicated in point 4.10 of the SWZ. 4. The contracting authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 7 of the Public Procurement Act. 5. The Ordering Party does not reserve the obligation to personally perform key parts of the contract by the Contractor. 6. The Contracting Authority shall allow the participation of subcontractors in the performance of the contract. In the case of the participation of subcontractors in the performance of the contract, the Contracting Authority, in accordance with Art. 2 of the Public Procurement Act, requires the Contractor to indicate in the tender the parts of the contract that it intends to entrust to subcontractors and to provide the names of subcontractors' companies by the Contractor, if they are already known. Entrusting part of the contract to subcontractors does not release the Contractor from liability for proper performance of the contract. The requirements for subcontracting are set out in § 5 of the draft contract. 7. The contracting authority does not provide for the requirements referred to in Art. 2 point 2 of the Public Procurement Act. 8. The Contracting Authority does not stipulate that only sheltered workshops and other Contractors whose activities, or the activities of their separate organisational units, involve the social and professional integration of persons who are members of socially marginalised groups may apply for the award of the contract. 9. The Ordering Party does not specify activities related to the performance of the contract, which are related to the requirements of employment by the Contractor or a subcontractor of persons performing activities during the performance of the contract on the basis of an employment relationship. 10. The contracting authority does not provide for requirements for the contractor to carry out an on-site inspection or check the documents necessary for the performance of the contract referred to in Article 131 sec. 2 Pzp. 11. The Contractor will be obliged to have, throughout the term of the contract, a policy or other document of insurance against civil liability in the scope of business activity related to the subject of the contract (third party liability policy). The sum insured under civil liability insurance may not be lower than: 200 000 PLN. 12. The Contractor shall provide a warranty for defects in the subject of the contract for a period of 5 years in accordance with § 13 of the draft contract. 13. Within the agreed price, the Contractor shall transfer to the Ordering Party all economic copyrights to the completed studies and documentation without additional remuneration.
