Description

The contract covers the construction of Nihti, part 4 - the construction of the contract to the extent indicated in the contract documents. The construction project includes, for example, the construction of Nihti streets, shore structures, dredging of shore areas, quarry fillings and municipal engineering. This is the construction of an old port facility area as a residential area. The developer is the Public Areas service of the Urban Environment Division of the City of Helsinki, which also serves as a subscriber in accordance with YSE 98. Works in accordance with the contract documents must be completed and received, and the inspections required by the authorities and inspection bodies must be satisfactorily maintained on 30 June 2028. The contract form is an overall contract in which the contractor selected for the work acts as the main contractor acting as the main contractor within the meaning of YSE and Finnish legislation. The contractor is responsible for site management responsibilities and site services. On 7 March 2017, the parties to the CISA concluded a cooperation agreement under the name ‘joint municipal technical site’, in which the City of Helsinki is designated as the ‘main contractor’ and the other parties as the ‘subscribers’. In this agreement, the CIS parties have, among other things, agreed on the appointment of a joint security coordinator in accordance with Government Decree No 205/2009. All the responsibilities of the principal contractor mentioned in the commercial documents of this contract shall be transferred to the principal contractor from the ‘subscribers’ of the YKT site. Section 1.7 of the contract programme lists the contracting authority’s CIS parties, while section 3.4 lists separate contracts and other procurements by the contracting authority. The procurement limits of the CIS parties have also been specified in the Contract Limits Annex. In addition to the work according to the plans mentioned in the list of documents, the work includes site management responsibilities and site services concerning the separate procurement of the developer in section 3.4 and the procurement limits of the CIS parties presented in the contract limit annex. The contract includes milestones. Milestone 1: The tops of the beach walls and the streets surrounding block AK 10675 are ready with all the work to start the construction of the house in block AK 10675. Ready 23.10.2026. Milestone 2: The lower parts of the waterfront walls and the streets surrounding block AK 10676 are ready with all the work so that the construction of the house can begin in block AK 10676. Completed on 22.10.2027. The work is carried out as a total price contract. The construction site will be implemented in its entirety as a low-emission construction site, the requirements of which can be found in section 4.2 of the Work Limits Annex. The amounts indicated in the plans are not binding on the subscriber. The contractor selected will be the tenderer who submitted the most economically advantageous tender. The most economically advantageous tender is the one that is the cheapest in terms of price among the tenders that meet the suitability requirements set by the developer. The subcontractor/subcontractor of a contractor who is in a contractual relationship with the contractor has the right to continue to subcontract the contract/subcontract. Concatenation of the procurement/contract beyond this is not possible without a particularly justified reason and the written consent of the client/constructor must be obtained.
