Description

K26109 Acquisition and transport of waste collection containers in 3 parts: Part 1: 1 100 litre metal waste containers Part 2: closed containers with a minimum of 5.5 m3 and a maximum of 6.5 m3 Part 3: Containers with a minimum capacity of 13 m3 and a maximum capacity of 15 m3 with rollers, open, parts 1-3, BT-750 Continuation of other economic or financial requirements: With regard to the proof of economic and financial capacity, the Kbt. Sections 65, 67 and 69 of Decree No 321/2015. Act on the basis of Section 19 of the Government Decree of 30 October 2011. Proof of suitability shall be governed by the Public Procurement Act. Section 65(6)-(8) and (11). The contracting authority hereby draws the attention of economic operators to the fact that the Kbt. Pursuant to the provision of Section 69(4), the organisation making its capacities available shall submit the certificates only in respect of the suitability requirements. The Kbt. Pursuant to Section 65(8) of the Civil Code, an organisation whose data are used by the tenderer for the purposes of its certificate of economic and financial capacity is subject to the provisions of the Civil Code. In accordance with Article 6:149, the contracting authority shall be liable as guarantor for the damages suffered by the contracting authority in connection with the non-performance or defective performance of the tenderer. The Kbt. Section 65(11) shall apply in the event of succession.
